I want to fire my attorney. (LONG)

Ugh. I'm so irritated with my attorney right now. My divorce techincally could be finalized in as little as 9 weeks from now (it sounds so much shorter saying weeks than 2 months lol). However, I haven't even seen our final papers yet.

Keith and I have agreed on everything that is to go into the final divorce papers. I sent this information in an email to my attorney 2 months ago. I just recently got K's 2010 tax returns, so I forwarded that information over as well. In the email I said something to the effect of "Please let me know if there's any additional information you need from me to proceed, or if I'm good to go". You would think a courtesy "We have everything we need, thanks!" email shouldn't be that hard to send.

I haven't had any communication from my attorney in 2 months, with the exception of a bill for $500. I called the courts where our divorce is filed to see what I need to do to proceed without an attorney. The first step is to get my attorney to file a withdrawl from my case.

I called my attorney's office, fully expecting to get his assistant's voicemail again. I explained that I was concerned that I haven't heard from them and she apologized over and over again. I also said that if I don't have a timeline of when I can expect a draft of the final papers by the end of the week, I will be asking my attorney to file a withdrawl from my case. She assured me that my file was on his desk and that she would get with him as soon as he returned from court.

I understand that he's a big-shot attorney (which he really is) and I'm just a typical divorce-with-kids type of case, but come on. I'm the one paying money for his services -- I'm the client, the customer. He should be bending over backward to ensure there is open communication and I'm kept happy.

If I don't hear from him or his assistant by Monday, I'll be calling again and requesting that he file a withdrawl from my case. However, if it's taking him this long to touch my papers, I can't help but wonder how long it would take him to do that. The lady at the court said if the 6 month mark is reached without any "activity" on my case, it would be dismissed and I would have to start all over again from scratch. Which would mean another $230 filing fee and ANOTHER 6 month time-line for my divorce to be finalized.

*sigh* What a waste of $240/hour.

  • Hey A!  You know I work with a "big shot attorney" and there is NO reason for him/her to not return your correspondences.  I don't care how busy DH is, he returns phone calls and emails the SAME DAY!

    He is in trial today, but takes his lunch break to call clients.

    Your instinct is right on.

    I can understand that I might take a slight back-seat to more pressing cases, but 2 months is beyond ridiculous IMO. And up until this point, both he and his assistant have been very prompt in any communications with me, so that's part of the reason for my frustrations.

    I'm giving him until the end of the week and then I'm done!

    She didn't mention anything about a vacation when I spoke with her today. And unless he was in a 3rd world country with no means of communication for 2 months or something equally as extreme, he really still doesn't have an excuse.

  • How ridiculous that he can't follow through with you. I'd also call everyday until you are able to get an answer. You shouldn't have to waste your time like this :(

  • Ugh! So frustrating! You are completely right to be angry with the situation. Like you said, you are the client/customer and he should be the one making calls to you to assure you that everything is going good or if he needs anything else. I'm sorry that this is becoming so frustrating to you. I would give him until Friday to call you back and then call him yourself. If you still can't get in touch with him, i would follow through with your plan to have him withdraw from the case on Monday.
  • Ugh, as if going through a divorce isn't enough to deal with. I hope he gets his act together and doesn't cause any delays.
