Caylee's Law

Have y'all heard about this? They're trying to pass a law that makes it a felony to not report your child missing after 72 hours. The radio DJ that was talking about it said that it would bring CA to justice. If they pass this, will they be able to charge her with it? I was under the impression that she can't be charged with anything regarding this case again.

I think it's awful that they even have to make this a law, only idiots or someone that's hiding something wouldn't report their child missing.

  • I agree that it is totally ridiculous that they would even have to write a law like this.  I also believe, that unfortunately they cannot go back and charge her using a law that was not in place when the incident occured Angry

  • My understanding is that she can't be charged on any of the same charges again because of double jeopardy. They could probably charge her with something different if they came up with additional evidence, but I don't think this would qualify as I'm pretty sure you can't charge someone with a crime for a law that came into existence after the crime was committed. I could be wrong though.

    This is really more of a move to prevent people from using a defense like hers in the future. 

    ETA: There's a lot of talk that she'll be held financially responsible for all the time and resources spent searching for Caylee since she allegedly knew where she was all along. As she didn't testify I'm not sure if they can hold her to that...she may be able to change her story now. But if they can, then any money she makes from book deals, etc. would go toward paying lawsuits.

  • No, they couldn't charge her with it because it wasn't against the law at the time of the occurrence. Can't apply laws retroactively like that.

  • I think it's crazy that a law like this has to be passed, but I also think it's pretty damn ridiculous that a law like this isn't already in place. Did anyone see Juror #3 on Good Morning America this morning?

  • I agree that it is really sad that there is even a need for a law like that.

    I hope they do make her pay back the fees associated with the search for Caylee, she should be responsible for it since her lies are what caused the state to spend so much money looking for Caylee.

  • I'm thinking about this some more and I'm having a problem with the 72 hr thing. How is that not insane as well? 3 days? 3 whole days??? Don't studies show that most missing people are dead by this point?

    Yea, the 72 hours bugged me as well.  I feel like it should be 24 hours.
