MI leave laws

Hello all :o)

 I am scheduled to go back to work at the end of August......I am wondering what the laws are in MI, if any, regarding returning to work from Maternity Leave. I am still unsure if I am going to continue to work......If I go back to work and then decide I would like to stay home, do I need to stay for any certain amount of time before I put my 2 week notice in....legally? Just not sure if there are any laws regarding this....I guess I am assuming that since I have collected leave that I have to go back to work for like 90 days before I can quit.

  • I had a friend quit right before she was supposed to return to work and there were no issues.  Although she only received 6 weeks of maternity leave and they used her husbands insurance plan.  It might depend on if they paid your premiums while on leave.

    It's always best to email HR so you can have a response in writting.  Just make sure that's what you really want to do, before you contact your company.  Because if you change your mind, they may have already started looking for a replacement.

  • There's no state laws (that I know of), but your employer might have their own policy in place so you need to check with them

  • I know at my organization, if you quit right after your leave is up and you've used up all of your sick/vacation days for the year, then you have to pay back those days.  I don't know about benefits though and how that might work.  I'm sure that is a company-specific thing.  I just haven't checked into it.

  • I don't think this was a state law (and if it was it was for NY- so not much help for you) but when I  went on maternity leave (2x)- my work paid me 6 weeks- but only $210 each pay period- I was able to supplement with my vacation and sick time. My company allowed you to take up to 1 year off (2 years if you went through some hoops)  I did the one year the first time with the thought I would not return so i used up all my time. I ended up returning for 1 year, got pregnant and took another year off. 2 months before I was to return to work, I went to my boss and told her I was not returning.  There was no negative issues with it at all.

     

    Good luck with your decision- it's one of the hardest I had to make!

  • Thank you so much everyone! I appreciate the feedback....I have read through the policy and can't find anything regarding it......which is why I wanted to make sure if there are any MI laws or not....I have been with the company over 8 years so I definitely deserve my maternity leave.....lol  :o) I don't want to have to pay it back know what I mean? I will for take the suggestion and call my HR rep to make sure. Thanks again!

  • I know I'm quite a few days late but if you have benefits through the company and are on FMLA leave and you do not return due to your own decision (not medically related) for over 30 days the company CAN come back and charge you the employer portion of the benefits they paid for.
