It does seem like there is more detail they aren't sharing. Was the kid up next to the portable desert table? that is kind of what it sounds like. if so, those are the kinds of parents that get kids banned from restaurants
I'm not sure what no flaming means. If we are critical of either side is that flaming? Then how do we share our thoughts?
Anyway... Agree with Rayskit. If the parents let their kid get close to the dessert table, it is their failure and they have no right to sue IMO. It's bananas foster. How many times has bananas foster been prepared in Houston with no such incident? It isn't a bananas foster dessert if you don't prepare it while the diners watch. I mean, I guess it is, but that is part of the whole fun of ordering it.
Regardless of who is at fault, I feel terribly for the poor child.

Poor kid. I'm waaaaaay too familiar with what burned kids go through, I see so many of them.
If the parents let him get too close, well, part of the blame is on them for sure.
But still, poor kid.
I don't think you're "that mom." I don't have kids but it doesn't sound like the best idea to me, either. Who the heck orders a flaming dessert then doesn't mind their children while it's being made?
There aren't enough details in this case but it really sounds like it was a combination of an accident and the parents just not being as mindful as they should have been, with a little dash of lack of common sense on the parents part.
You aren't that mom and I have the same thoughts. Not so much for HAVING the young kids there as much as those who do but just don't bother supervising them. I feel bad for that kid but I don't think I would have ever ordered something like that when DD was small. Kids are to curious and it is a huge risk they could get burned.
