lanlord anyone?

We had to evict a tennant who was past due. Anyone experience this. I'm curious as to the process if u took them to small claims court. Tx! I'm thinking I will start by sending a notice to attempt to collect the past due amount in hopes to gain their new address.

    That sucks Sara!  I'm so glad we got a good tennant in our rental.  We are new at renting, so I've never had any experience having to evict a tennant.  Keep me posted as to what happens.
  • Chances are if they can't pay rent they aren't going to pay you anything. Even if the judge rules in your favor it could be years for you to see it. Do they owe a lot? Damage the property?
  • I do agree kel, they owe over $2000 but we would file to garnish wages after we win. Mostly rent and late fees but she is loosing deposits for pet clean up and some repairs

    Wouldn't it be silly to go after them for only $2000? Wouldn't court costs and lawyer fees take up almost all of that???

    And like Kel said, if they can't pay rent chances are they can't pay a judgment either. Not to mention, you could file all you want but you still may never see a dime, because all they have to do is file bankruptcy and then you can't touch them.

    If it were me, IMO, I'd just cut my loss and move on. 

  • I guess if you know for sure they have stable jobs you might get the garnishment. If however, they don't work, move from job to job it is going to be hard to get. I agree, I'd make sure it is worth it financially first. If they make very little money it might take years to see. I leased apartments for several years so have a little knowledge of the process. Glad you have good tenants now! Did you do credit check etc on the other residents? Asking b/c a friend of mine is going through the same thing and she never did a credit check on the tenants! I couldn't believe she didn't!
  • Small claims court is only $50 to file if they r a no show u win. We would win reguardless, she owes the money per her lease contract. She works for the county so I don't see her leaving the job. I figure its worth the $50 gamble to recoop some of our loss monies..

    I agree, this does seem worth it. I believe if they garnish they can garnish bank accounts also. I had to deal with that some when I worked at the bank.

     I didn't realize they could garnish bank accounts! That would suck one day going into your bank account and all your money is gone. Surprise

    Yep. They can only take overa certain amt, but I don't remember the magic number, I just know most of our customers never had that much. Regardless of the amt in your act the bank did charge a hefty $75 legal processing fee. Most of the garnishments I saw were for back child support.
