Taking a stress related LOA?

Have any of you ladies felt that you needed to take a stress leave from work for a short time and have you?

This last week at work has basically been the breaking point for me and I can't take much more. I've started looking for a new job, but as you know with this economy the search is slow at best.

I tried talking to my boss this morning about my stress level and the amount of work I keep having to take on from both her, her boss and my daily work has become overwhelming.

Her response was, "just try not to stress out". I just felt like exploding on her in that moment, but I held my tongue.

I have a weeks worth of vacation scheduled for October, but I don't think I can hold out until then. Plus anytime I take vacation or even a sick day, they still call me with work related questions, so I really don't get a break.

I'm just at my wits end today, I feel so defeated.

Re: Taking a stress related LOA?

  • FMLA covers a serious health condition, and if your doctor will vouch, you could technically take leave.  This assumes that the stress is detrimental to your health, of course.

I'd be more likely to take vacation now, though.  Even if you took an extended weekend (4 or 5 days), you'd probably feel a lot better.

When you do take time off, let them know that you're unavailable by phone.  If they call, you don't have to answer.  Or just turn off your phone.

  • Take some time off now and turn off your phone.  Part of the reason they call you is that way back when, you answered their calls, so they think they can still call.  So... don't answer.  Claim your phone died, or you were out of your service area, or... whatever.  But stop being so available.

  • Unfortunately, they blocked all vacation requests for the remainder of the month due to some huge project that we have been working on, so at this point I feel stuck.

I need to look up the HR policies regarding FMLA, because this stress is messing with my health and I'm at my breaking point.

  • If your doctor is willing to give you a certification that this is a serious illness that prevents you to work they will have to give it to you. I had my counselor and doctor do this for me to be able to go take care of my mom and being paid. I was however already been diagnosed with depression and dealing with it for months so that helped my case.

  • I'd find ways to destress after work/on weekends and, as ECB said, stop answering your phone.

  • You can use FMLA (it's unpaid) for any illness including mental health. It's federally mandated for companies with 50 or more employees. They have to hold your position no matter why or how much time you take off.

Do you have an EAP through your work?  If yes, you really should call and speak to someone. One specialties of the EAP is to help employees (and managers) with workplace troubles. They can also advise you about leave and help you with a referral to a counselor.

There are limits here---you have to have been working there at least a year, you get a maximum of 12 weeks/year off, they may require medical documentation, and they don't have to hold your exact position---they just have to give you a comparable one when you return.

  • I hear ya.

I haven't had a proper vacation in over 2 years, and while I have one scheduled in 5 weeks, I am having a lot of trouble waiting for it.  Also, it's only a week off, and I'm worried that won't be enough.

I guess my problem is I just started a new job, so I feel like I can't ask for a LOA.  I've been tempted to ask my therapist to vouche for me, but I don't really want folks at work knowing I have anxiety/depression.

Anyway, regarding your problem, I would say go for it if you can get your doctor to vouche.  We don't get enough time off to really live our lives/relax.  If you can get it, take it.

    Good luck!
