I need more info before I weigh in.
I almost hit a jaywalker the other day because I was glancing from corner to corner as I passed through the intersection and happened to be glancing left when he entered the intersection at my right. The sun was really bright and in my eyes so I didn't have much peripheral vision. He proceeded to cuss me out NY style because I almost hit him - but he shouldn't have been entering the street between cars and not at a corner.
I don't think the drunk driver should get a slap on the wrist, that is for sure. But I'm not sure the woman made a safe decision.
The article mentions that she didn't want her kids outside for an extended time after dark. If it was a quiet street with no traffic and she was hurrying them to safety and it would take too long to get all the way to the corner, cross, and come back, I'd feel more on her side. But the relative risk would depend on how busy the street was.
Either way it is very very sad.

That's a pretty broad statement.
3rd hit and run? I too need more information. She was crossing the street illegally with kid in tow. Car doesn't see them or what have you and kids gets run over. Multiple people are at fault here I think but mainly her for not using the crosswalk that was three tenths of a mile away from her. I don't know. This is a tough one.
Even if she gets no time at all, the guy who was drinking and has 2 prior hit and runs only served 6 months for killing a child. I mean, an accident like this can happen to anyone but this guy is showing a pattern and he was drinking and on meds.
Based on the information presented in the article, I definitely think he should have gotten a more severe sentence. However, one of my ILs went through some legal problems recently & had to serve 6 months jail time. The stories printed in the paper/on the news do not match eye witness testimony & some facts I know to be true about her home. Based on what the news said, her crimes would have been much worse than they actually were. So I try to look past what is in the news.
Based on this info I would want to lock that MF-er up for several years. That is outrageous.
As to zAngel's comment about our justice system - we have a legal system that pursues justice, but I don't think our system is completely about true intrinsic justice either.
For example, in many states a repeat DWI person will get a lighter sentence than a pothead with enough marijuana on him that he MIGHT have a desire to sell it. Maybe he just smokes a LOT. If he is toking it up in his apartment by himself and not hurting anyone, he should not get a harsher sentence than someone with multiple DWI/DUI convictions.
Also rape sentences in this country are outrageously light sentences and it's very very hard to prosecute them because of how our society judges rape victims. A rape victim deserves justice but only a small margin actually ever get it.
The guy who kidnapped Jaycee Lee Dugard - he never should have gotten out. He is sick and not able to be rehabilitated from previous crimes but was let out early because of overcrowding and good behavior, and ended up robbing her of 18 years of her life. That is not justice.
I think we have one of the fairest legal systems in the world, but there is still a lot of opportunity for it to improve in terms of Justice.

I don't really see why she was prosecuted in the first place. If she is gets no sentence, why waste the money/time on a trial?
