Re: I'll take liar for $2000, Alex
I'm suspicious as well.
I've seen what happens when military personnel don't handle their personal affairs and their unit is contacted. It's not pretty. My previous commands have gotten involved in matters much smaller than this, so I can't fathom a unit essentially ignoring this situation.
This is what is stumping me.
I'm still stuck on how the hell he managed to go through the process of getting housing, getting back to work, and getting the kid enrolled in day care, etc without giving some kind of explanation to his COC as to where his wife was and why she stuck him with the kid?
I doubt they would just take his word or even his lawyer's word since I would imagine the lawyer wouldn't be able to talk to them and they'd be even more suspicious once she started calling and accusing him of kidnapping.
Especially given that he recently returned from deployment. You're telling me that wouldn't raise PTSD questions from his COC?
Also, as I said in her post, I'd be hard pressed to believe they wouldn't force him to tell her his address and work out some visitation. I'm also hard pressed to believe any lawyer would endorse snatching a kid and not telling the other parent where the child is.
At minimum, wouldn't a lawyer file for an emergency custody order to cover their asses?

I don't understand how contacting his chain of command wasn't the first thing she did. The command will deal with all issues, even ones as minor as a spouse not calling home anytime recently and telling them to contact their family. So without a doubt they wouldn't sit back and do nothing if everything she was saying was true. She could easily be leaving out some important details to make herself look better, such as she is a drug user, neglecting her child, etc. It definitely doesn't make sense, or add up at all. I fully believe there is more to this story.
Seriously. And if it's legal for him to take the baby, then it's extra legal for her to show up and snatch him back, yes?

But she's broooooooooooke. I don't care if I had to sell all my shiit I would be driving to CO and posting up outside his work.
I haven't gone because he's 12+ hours away and I don't know where he works, nor where he lives or where DS is in daycare. I know that he's on post, but I've been on that post maybe 3 times because we lived off base and he would never take me on there unless it was very necessary. So when I get down there, then what? Is there someone I can talk to and find out where to go?
You've already been told where to go in your first post. And how did you contact his command yet you couldn't find an address for his shop? If you know his shop then you drive your azz on base and ask for directions. Or google.
Oh sweet jesus.
Do you know what he does? Because really, if he's infantry, he's on this side of the post. If he's artillery, he's on the other. It doesn't take a rocket scientist to crack open the base directory and find out where the rakkasans or whomever are located.
Hell, go find the sergeant major. His name is in there. Go to IG like I told you in the first post. They know where everyone is. Go to JAG, same deal.
I'm really hard pressed to believe any mother would be this fuuking wussy about getting their baby back. The dude at the gate can give you directions to JAG or IG or even the MP's.

You know what his job is, right? Easy. Just ask where his squadron is. Go to the legal office when you get there. Ask what your options are. Or, just show up at his squadron and ask for his commander. Honestly, as a mom, I would be camping outside of the base and watching cars arrive and leave if I had to, in order to get my child back.
I'm with you there. If it were my kid I'd be doing anything and everything in my power to get her back. Custody order or no, this is still kidnapping.

THANK YOU.
Word!
Ugh, it does and that makes me sick to my stomach.
Seriously agree with KC, the lack of urgency is frightening to me. If this were my baby I would have been in CO as soon as I found out he was there. I would have hitchhiked if I had to.
I asked my DH what he would have done as company commander in a situation like this, his first response would have been to call JAG. He looked up Army Regs and, from what the OP shared, while he is skating a very fine line, it appears that the STBX may not be in the wrong (at least in his mind)(not that it is right). Because they have an oral agreement, not a CO, there is nothing to be enforced. While he may not be the model father, at this point, it is difficult for us to ascertain what, if any, laws have been broken.
The situation sucks. I can't imagine what the little boy thinks is going on.
