I am pissed - tenant issues

OK, back when I lived in my house I had roommates at times. So then when I moved out and it became officially a rental house, we just sort of kept up the same system. The 2 girls who were living there stayed there and we kept everything on a per room basis, rather than a "rent the whole house for x price" kind of deal.

Unfortunately, since things were so casual in the beginning, I never asked those first two girls to sign a lease. As other people came and went over the following years, we did leases for those people. I know, it was really dumb, and I am definitely learning my lesson.

We have decided to change how we rent the house. This by the room thing was too much work and there was too much turnover (every 3-4 months because the 3rd room was ususally filled by interns just here for a semester).  Also, we were soon going to be down to only 1 room filled, and that was not financially feasible.

So, after several months of looking, we found new renters who would like to move in next month. I gave my current tenants 30 days notice to move out. There is no lease but as far as I know that's the default for non-lease situations. Well last night one of them called me and said she is refusing to move out by the date I gave her and will only commit to being out by Oct 1. WTH. How does she think she can just say that to me. You could never say that to any other landlord, she is trying to take advantage of me because we are (were?) friends.

She has been a difficult tenant this whole time, but I let things slide because we're friends and because I was just grateful to have the rental income. But this just pushes it to a whole new level. I have new tenants looking to move in on that date. I even told her we could be a little flexible (apparently she will be out of town on the date I gave her. Not really my problem, but whatever.) But she is insisting she's staying another month. How does she even think she can do that?? I have tried to be nice but now it's time to lay down the law. 

It's just so absurd, I was speechless. This is going to get ugly.

  • Wow, I hope you get it sorted out. She sounds delightful. If you need me to bitchsmack someone for you, I will :)
  • WTF?! You're giving ample notice. Unfortunately that's why it sucks to involve friends & business. Hopefullly it all gets sorted out amicably soon.

  • What a PITA!  We also rent out the home that I bought before I met DH and I know exactly how you feel girl.  Hang in there and I hope it works out OK.

  • Maybe you should kindly mention in passing that you own the property, and since there's no lease, she thinks she's not tied to anything, but neither are you. As long as you are within your rights by the state, then if she stays another day, you are free to get the police involved to remove her. 

    Seriously, though. I obviously don't know your relationship with this girl and whether you think it's worth saving, but I've learned that when friends will do this kind of crap to you, they're not really friends anyway, and it will get a whole lot worse before it dies anyway.

  • Time to talk to a lawyer and consider an eviction notice.
  • I've been in your situation, and you have given her 30 days notice and if she isn't out, you can have the police come in and escort her off your property. If there is not lease, she is basically month to month, and you have given her in writing a time that she has to be out. It's $hitty, but she is being $hitty to you too.

    Make sure you get a free consult.  Most will do that over the phone.

  • That really sucks! I agree -- get the eviction notice. And definitely start now, not after your deadline, since there are strict guidelines about the amount of time you have to give them, and that only starts once the eviction notice is official.
