I just saw and article on the news this morning about Cristian Louboutin (CL) taking Yves Saint Laurent (YSL) to court because YSL is making shoes with a red sole. Husky, I thought you might have some opinions on this
And also, some legal pp, can they win? Their argument is that the red sole is like a signature.
I for one would buy YSL with a regular sole and CL with a red sole - and for that matter, I wouldn't buy any other red-soled shoes to make people think they were CL, the red sole is just 'sacred' in my mind, lol.

also, I could understand if it was some cheaper brand trying to copy it, but why would YSL do that? And if I was going to spend $$$ to buy red-soled shoes, why wouldn't I just buy the CL?
The only argument that the news article proposed (from some 'expert' fashion person, who knows who it was) was that it cramps the artists who design shoes because they would have to worry about whether they would get sued
I guess I don't have sympathy for the shoe artists of the world? Just don't make a red sole...? Although I'm sure it just opens the gates for other law suits about design. I just don't feel like this is that complicated.

I'm super torn on all of this. And in no means, do I consider myself a CL or YSL expert. However, if you really want to do some seriously reading there's been a thread that's been going around for a few months in the purse forum CL subform and those ladies are like CL gods.
And for a little extra reading:

YSL is on the left, CL is on the right. And I will add that YSL soles match the uppers on the shoe (ie, purple shoe, purple sole, blue shoe, blue sole, etc...)
So, with all of that being said, I think it upsets me more that it was YSL that made the copy bc YSL is a leading fashion house that does not need to copy another designer. A lot of their items and specific shoe styles have their own cult followings.
If it were Steve Madden or some other designer known for ripping off designer shoes I don't think I'd be as upset.There are other designers that do the colored/patterned bottoms, but they don't do red. There was a small uproar a few months ago bc Paris Hilton (a CL wearer) did reddish-fuchsia bottoms on her shoes and I think they pulled those at some point.
But if you know designer shoes then you know that the styling of a YSL is completely different than the styling of a CL. I happily own and wear other YSL shoes, but I wouldn't ever get a pair with red bottoms. While both are beautiful shoes IMO red soles are reserved only for CL shoes.
So, I guess the conclusion that I'm coming to is that CL is right and YSL should not be allowed to use the red sole.
I think the whole thing is silly. I know that I don't have any sort of reign on any of this but the thing is that if they're able to sue about this, then many brands will get sued because they all copy eachother.
I agree with UW that it's kinda ridic that one big name is copying another... don't they have enough stuff to keep them busy?
this was the part that was the most confusing. I know that brands copy each other all the time, this just didn't make any sense to me.

I'd, also, be interested to see how this lawsuit plays out.
You can argue that hashmarks on fabric can be interpreted only so many ways, but this is a pretty blatant rip off.... along the lines of the red soles.
F21 gets an eye roll though bc they do this all. of. the. time. whereas YSL really should have known better bc their stuff is knocked off quite frequently and I believe that they go after those folks too.
