Matnerity leave

Hopefully in a month my leave will start. I am so ticked with work because their matnerity leave policy that I read and interpret, along with many others, said you can use sick, vacation and personal leave. HR met with me last week and they said that is not what that means. They said that you need to look at what the sick leave policy says and sick leave is not meant to extend your leave or stay at home longer or bond with your child (this statement upset me). No where in the policy did it say to look qt what sick leave means and if it had said that then I and others would have interpreted the policy the way HR is. It probably is my fault for not asking them earlier but they also had my leave request for 4 months and she thought that was how I was seeing it (well then why didn't you meet with me earlier ).

They are saying I have to work up until I give birth or have to take vacation, I get 6 weeks of sick time then I have to take vacation or no pay. If I have birth on due date I would have to go back on dec. 12 and that would use all my vacation and the way they ate changing time next year (going to PTO) I would have maybe 4-5 days to start January off and that is if I don't get sick between now and giving birth.

If I did the way they are talking about but go back on dec. 5 then I would have 8-9 days and I would feel better about that. I got to thinking if they are going to change our time (we will get credited 1 hour of PTO time for every 6 hours of sick) why give them some of my sick time. I am going to talk with my OB to see if he will pull me out on September 12 (I have been having a lot of back pain and it is all I can do somedays to sit there) and then they will let me use my suck time. December 5 is the date that I would probably have to go back, if she came on time, and that would give me about 7 1/2 days to carry over. She would only be about 10 weeks and I just don't know right now if I can leave her that early. I know it is a month earlier than I planned and I would only have to work about 2 1/2 weeks before we get off for Christmas, but the thought of leaving her that early and the principle that their policy should have been clearer so I wouldn't have thought I didn't have to come back till January.

As much as I hate to say this but if she came a week late then that might be the perfect solution and that would put me at December 12 and would only have to work 7 days and nothing goes on in December and that week is usually full if parties so that week might be better to start back in. If I have to have a c-section that would probably make me have to be "incompacted" fir 8 weeks instead of 6 so I might not have to return till January and will have time to carry over. I want to make sure I carry over a decent amount in case I am sick, she is sick, doctors, etc.

This post is more of a rambling then anything and to get out my frustrations. Hopefully it is not wrong to ask him to pull me out 2 weeks early or maybe even a week? I was planning on using that week before to rest some, get last minute stuff done and depending on how I feel catch up on some craft stuff. I did tell them that when the redo the manual they need to make wording clearer because what they are saying in the manual and what they tell me are two different things.

  • Sorry for misspellings, on phone. The 6 weeks is what they are saying is FMLA for normal delivery and that is the time I will be "incompastated" and if I had a c-section it would be 8 weeks. I know I should be thankful for any time and I am, just upset with how thongs are written but that is not what they mean.

  • I feel ya Heather! They make it so confusing!!! I get 12 weeks unpaid leave. My short-term disability will pay 60% salary for about 6 weeks. They are still processing that so it hasn't started yet. I am using 1 sick day per week to cover my payroll deductions for insurance and when I run out of sick time it will take from my PTO, but I chose to reserve one week PTO for if I or Ellie get sick. I started my leave a week before my de date. I really thought Ellie would be early because I measured about a week ahead most of the pregnancy and my Mom had went a week early (they say it tends to run in the family). I had to submit my leave paperwork at least 30 days in advance, whih is a pain since you don't know when you're going Togo into labor!! I'm on my phone too, forgive the misspelling!

    FMLA applies to all public agencies, all public and private elementary and secondary schools, and companies with 50 or more employees. - it may not include heather's organization... ??

  • Yeah i was going to say e same thing as Steph, I don't think heathers company is big enough to fall under the federal regs. And fmla doesn't tell employers how to or if they need to pay employees when they are out, it is just to give the time and ensure job protection. And while it is crappy, sick time isn't intended for use of taking a care of a not sick baby and bonding time, though a lot of companies do allow people to use it to extend/or to get paid during their leaves. I'm sorry heather, it is crappy for you to find out this late in the game. I would be upset too. and it does sound like they need to update their manuals on this stuff. Are there not a lot of people that take leaves, so maybe that is why they don't know what they are doing?

It is just frustrating because of the way it was worded but we will make it work. I know in the long run it is just being petty about having to come back a little before I expected and I know that. I was very upset Thursday and Friday morning, but we will work it out and if come November I don't feel comfortable leaving her that young we will work something out. 

    Mel--To answer your question I guess they didn't feel a need to word it correctly because in my 13 years there everyone who took maternity leave came back for a few week or a month and gave their notice, so I guess it didn't matter to them if they used all their vacation time because they didn't have to worry about carrying anything over because they were leaving. I am the first that is actually coming back. There are some young singles there that will eventually get married and possibly have to use maternity leave and I want it worded correctly for them.

  • Definitely look into seeing if your doctor can do a new form for you.  I remember, now that you mentioned the 6 weeks of being incapacitated, my dr left it indefinite but they needed a definite amount of time, so since I was taking 12 weeks with Corinne, he put 12 weeks for me.  I'm doing the same thing again this time with Bella.  I am very lucky, though, I am allowed to use accrued vacation and sick time to cover the 12 weeks of FMLA and have a short term disability policy on top of that.  I would totally see if your dr can help you out though.  He put the 12 weeks regardless of whether I was going to be delivering natural or c-section.

    This is illegal. You are legally eligible for 12 weeks unpaid maternity leave. The only thing they can tell you is how you will be paid/not paid for it. They might pay you for only the first 6 weeks (this is how most short term disability plans work as well, you only get paid for 6 weeks for a vaginal delivery and 8 weeks for the c-section, and with that there is a 2 week waiting period, so it is really only 4 and 6).

    I would go back and tell them that you are legally allowed to be out of work for 12 weeks with job protection to care for the child and ask them to clarify what they told you. Do you get short term disability through work? Maybe they were talking about you can only have 6 weeks for disability and then you can use your vacation and not sick time for the rest.   

    Maybe I misread your original post about it, which could be as it has been a long few days!

    I think that is what they are meaning.

    It is frustrating because there are other things they say that don't mean what they say.

    I know I am just probably being petty and I really wish I could just stay at home.
