Conflict Between Companies

So, I am working as a tutor for an in-home tutoring company, but was also planning on starting work at another tutoring company. The in-home tutoring company told me that there would be no conflict with me working at other tutoring companies, but when I went into the second company today to sign my paperwork, they said that I could not work at both companies, and that I had to choose one or the other.

When I get home, I call the first company back and explain the situation to them, but they still insist that there is no conflict and that the other company is just being stubborn. They also told me that if I wanted to continue working with them, that I shouldn't have said anything to the second company about me working there, and there wouldn't have been any issue.

Call me crazy, but doesn't that sound a bit shady to you? My concern now is that I have to choose to either stay with the first tutoring company who has given me exactly one hour of work so far in the month since I've been hired, try to work at both companies at the same time which would involve an amount of deception toward the second company, or give in my notice at the first company so that I can honestly tell the second company that I am free to work there.

I can try to call the second company to give them the explanation that the first company tried to give me -- that since I am an in-home tutor, that's considered private tutoring and doesn't fall under the competition clause -- but I don't think they'll go for it quite honestly. I'm really bothered by all this, especially the fact that the first company is essentially asking me to lie about working for them so that I can keep my job at the second company.

What should I do? I need as much money as I can get, so it would be best if I could work at both companies, but I don't think I can pull that off without flat out lying to the second company.

    Agreed. If #1 isn't giving you many hours anyway, it doesn't seem like you have much to lose by going completely to #2.  

  • Thanks guys, I appreciate the advice. I need to sleep on it and figure out whether the extra hour drive to company #2 is worth it or if I should stick it out with #1 and see if a closer site will open up. I was really counting on both incomes to help pull me and my fiance out of the financial hole we've been in this last month...

    Also, not to get off topic, but I just had to say that nieman, your cat looks exactly like mine! I've never seen another long haired tortoiseshell pattern on a cat except for mine before. ^_^ 

  • are they actually making you sign a no compete clause...if you aren't signing anything and it's not in any contract then I don't see where they would have a leg to stand on
  • There is a "no compete" clause in a contract that I have to sign before starting work at site #2 unfortunately. I would really prefer to work at site #2, but I have a mandatory 30 day notice if I want to leave site #1, which means I can't start at #2 for another month. It's just really frustrating, because I was all set to start working there this weekend after them already having delayed it for a month, and now it's been delayed again. I'm starting to wonder if I'll ever find work that will actually pay me worth a damn.
