Update to bully buyer

So, after being told multiple times that he could not come into our house until Monday because we are still packing, moving, and working from home, the buyer shows up unannounced on our doorstep with his "interior decorator" (found out she's his girlfriend) and without his realtor. Luckily, my DH was home and answered the door when he wouldn't stop ringing the bell and knocking. DH patiently explained that we need more than same day notice and had given him a reasonable alternative (either come back on Monday or we can measure or take pics). When DH wouldn't let him barge into our house, buyer threatened my DH that he was going to pull out ... Again. We called our realtor immediately and sent realtors an email of what happened (lawyer said to make sure everything documented on emails). We are proceeding with our move out this weekend to show that we are upholding our portion of the contract. I also told our realtor that I want him present at the walk through. Buyer hasn't filed any paperwork yet to break contract. If you can, please send us a little Nestie dust. I know I'm not a regular here, but could use some positive thoughts out there. I just want this to be done. Yesterday was really scary. Thanks for letting me ramble...

  • I'm pretty sure you could have actually the police about someone showing up and demanding to be let into your house. I'm also sure that this kind of harassment is not going to tilt things in his favor if he tries to break the contract. I'm sorry you are going through this but hopefully this guy is just a douche and there's no actual wind in his sails.

  • If he does pull out, count it as a blessing in disguise.  Quite honestly, this man may continue to harass you after the sale with complaints and threats of lawsuits,

    In fact, you may want to ask you lawyer to make sure there's a clause in the closing paperwork that says any disputes must go to binding arbitration/mediation before any lawsuit can be filed. 

     

  • He's being more than a bully.  He's thisclose to breaking the law.  Think of it this way: how would you respond if ANYONE ELSE just showed up at your doorstep and demanded to be let into your home?  You'd say no, and possibly call the police if the behavior continued.  Treat him the same way.  It's probably in your best interest if he breaks the contract at this point.  Do you really want to be dealing with him any further?

    Additionally, get in touch with your lawyer, and continue to document EVERYTHING.  He should not be contacting you personally, his REA or your REA should be handling all communications.

  • i was hoping you would update but def didnt expect to see this!  This guy is out of control! Like the PP's have said document everything and notify all parties involved, its NOT HIS HOUSE YET, he has no right to demand to be let in at his convience.  I hope this whole ordeal is over for you quickly.  Def sending nestie dust your way.

    Just remember to force all communication through the realtors. You don't have to communicate/talk to him face to face and don't do it. If he does come back, tell him he needs to go through the agents. Like pps have said document it all (what happened, times, dates etc).

  • Also, you've said he can't come in until Monday - I wouldn't let him in at this point until the final walkthrough.  It's not his house.  If he'd been polite about getting in, sure, but you reap what you sow.  Don't let him in until the final walkthrough.  Don't worry about how it'll make things harder for him - he's being a first rate @sshole.  I wouldn't let him in my house before he owned it.

  • Wow what an ass! What does his realtor have to say? Obviously he doesn't play by the rules but your realtor/attorney need to tell his realtor (and boss maybe) that this is unacceptable. He has all the time in the world after closing and you are trying to get the house emptied for him.

  • I'm sorry to hear that things have gotten worse.  I would ask your attorney about that clause a prior poster suggested.  I don't have a ton of experience so I don't even know if thats possible but its worth asking about.
    I also think I would strongly reconsider allowing him in the house before closing unless thats a requirement.
