Update to the Bully Buyer

Final blow... he signed the Termination forms yesterday. 

He threatened us last week and our realtor told his realtor that we were planning on moving last weekend and to let us know as soon as possible to avoid wasting time and effort.  The jerk waited until the day before closing - less than 24 hours.  We have already completely moved out of the house, called and disconnected the utilities, and moved in with my in laws.  We do get $1K of his earnest money.  Small consolation to the two months of our lives that he wasted and all the stress he put us through.  We talked to a couple lawyers and it boiled down to being able to prove damages - being a jerk is not illegal.  The cost of going to court exceeded the $1K and we wouldn't be able to re-list the house in the meantime.

So disheartened.  I can't believe someone so petty and obnoxious did this.

    i'm sorry you've had to turn your whole life upside down due to this jerk.  hopefully you get another offer super quickly and you can be done with this process, asap!

  • I'm sure you went over this with your lawyers, but... could you sue him to complete the contract?  Not letting him into the house with his decorator is not one of the clauses in a real estate contractor that would let him out of it.  It's a legal contract - if you wanted to, you ought to be able to force him to go through with it, or at least keep a lot more of his earnest money deposit.  ALthough if I were you, I'd be glad to be rid of him, Lord only knows what else he would have put you through.

  • We did talk to a lawyer who said we have a strong case. However, his rate was $1000 to go to mediation plus $185/hr and $2000 to go to trial plus $185/hr. In addition, we couldn't relist the house until finalized. We know he didn't have much money, so even winning damages would be moot. It would also take months to go through the process. We'd have to prove damages and it would have cost money to hire experts to say how much we lost by taking the house off the market for him.

  • Thanks ladies for your support. I had to vent about the whole, long, frustrating process. Hopefully none of you will ever have to go through this. Our house went back on the market last night and I hope we get some traffic this weekend.
