Any landlords? Either way WWYD?

Ok, so this might get confusing and I am sorry in advance.

 

My dad has a house that he rented out. He went there last Wednesday to sign the lease with the guy and he came with only the first month and deposit not the last months rent. He said he would have the rest Monday. My dad edited the the lease to state he did not pay all the money and owed $1500 on Monday 8/22. Well today is Wednesday and the guy is still not answering his phone nor returning my dads calls.

He keeps asking me what to do and I think he should put a 3-day eviction notice on the door. WWYD?

  • What were the stipulations in the lease if funds were not paid?  We've always used property managers for the houses we rent out, so I've never had to research the laws, but I would see if Florida has a regulation requiring X number of days for an eviction notice.

  • Did your dad sign the lease? 

    I'm not a lawyer, but I think evicting someone is a lot harder than slapping a notice on their door.  Renters have a lot of protection with the law. 

  • Yes my dad signed the lease. We have had to do 2 evictions (on this and another property) in the past few months. The first step is placing the 3-day notice.

    Yes, he took possession the day they signed and started moving in that night. He finally answered the phone and put my dad off till the 31st on paying him.  I really hope this guy is being honest cause hes already starting to sound like the last tenant that he had to evict in May.

  • Did you guys talk to his previous landlord? Do you know if he has a history of being late? If he is already avoiding you and not being upfront and honest then that is just forcasting what is to come. From my experience, I would post a 3 day. You could wait until the 31st and if you do not receive it by let's say 5pm post it. Either way I wouldn't wait too long.
