So originally we were set to close on Friday 8/26. A week before the seller said they needed the weekend because they were getting a dumpster for all the stuff they were not taking and the dumpster could only come Saturday 8/27. So we moved the closing to Monday 8/29 (yesterday).
We were supposed to do the final walk-through Sunday but since that was supposed to be the worst of Irene we moved it to Saturday after the dumpster was hauled away. Everything was fine. They did a lot of work to the house to bring it up to code and hired an expeditor to get us all the COs for closing. We basically (and unexpectedly) got the basement re-finished in all new sheetrock and new fireproof doors down there. They also enlarged the basement bathroom for a shower stall.
We couldn't get in touch with our realtor on Sunday due to power outtages on her end. So we couldn't get an update on whether the closing would happen or not Monday. Monday morning two hours before the closing, as I am blow drying my hair, our lawyer calls to tell us a tree fell on the house ![]()
So we finally get in touch with the realtor who tells us the seller is at the house now... we make the 45 minute drive in about 25 minutes to catch them. When we get there the seller already has the tree removal people on scene as well as a contractor. The tree was totally uprooted. The trunk didn't hit the house, just the limbs, and they took a few shingles with them. The trunk totally crushed the fence though. We spoke to the seller's son and he said the only thing he has left to do is get the fence people in. Everything else has been prepaid and is going to be done by Friday the 2nd.
At the closing we had to sign a form specifically stating that no hurricane damage had been done to the house since the contract was signed. Our lawyer pulled us aside and said only to sign it if you really trust the seller's son. He gave us paid receipts for the tree removal and roofing so we don't think he would screw us. Especially after he did all that work on the basement. So we signed it... we think they are good people. When we went back to the house they had left us a bottle of champagne in the fridge.
So, in the end... I am really glad we didn't close on Friday the 26th because then the tree/roof/fence issue would have been our responsibility
. But, I do feel bad for the sellers having to take on almost $4,000.00 worth of damage that close to closing. Hopefully their home insurance will cover everything.

Your lawyer advised you to sign an inaccurate written statement so long as you trusted the other party? WTF? Did you give a sworn statement saying that the house didn't have damage at all? Or that the damaged was fixed?
I'm sorry you went through that, and hope it all turns out well for you, but seriously, I'm giving a big WTF to the lawyer.
Wow! And I thought our August 26th closing story was nuts.
