Can I collect Unemployment?

I have 2 children (3.5 & 8 mths), my mother takes care of both while both my DH & I work FT. But, my mother is 61 with Rheumetoid arthritis and it has now reached the point of impossible for her to care for them, it is just too much. I have tried daycare for my 3 yr old and she hated it and it was very expensive. Then I looked into having a "mommy helper" come in. But the days & hours I would need her was coming out to be over $800/mth. The cost of that plus my train pass per month I am better off saving and staying home. I thought, let me see if I could cut back at work to give my mother more of a break.

I had the discussion and ultimately my boss declined stating they really need someone in my position to be FT. So, my only option was to tell them that I can't do the hours anymore. So my last day is mid Sept.

I keep thinking to myself did I quit, was I technically let go? I'm confused. Am I eligible to collect unemployment?

  • It sounds like you quit, you told them you would not be able to fulfill your position any more.  You weren't let go because of downsizing or department cuts.  It sounds like you said you wanted reduced hours they said "no" and then you gave your two weeks notice. 

    I can't say for sure how things work in NY, but here in OH you would not be eligible for unemployment.  

  • It sounds like you quit. In SC, you would not be eligible for unemployment. You'd have to check with your state.

  • I am curious why you feel your state should pay you to stay home and watch your kids. NY did not choose for you to have children that you can't afford daycare for.

    I don't see that you meet any of the requirements your state has for UE. In fact, I see yours as one of the reasons you would be denied.

     

    You may be eligible for benefits if:

    • You lost your job due to lack of work
    • The temporary or seasonal employment ended
    • Your job was eliminated
    • There was an involuntary reduction in force
    • The company downsized or shut down
    • The company restructured or reorganized
    • There was a lack of company operating funds/orders 
    • You were out of work for any other business reason that you did not choose or control
    • Your employer discharged or fired you because you could not meet their performance or production standards, or their qualifications for the job
    You may be denied benefits if you:
    • Were fired because you violated a company policy, rule or procedure, such as absenteeism or insubordination
    • Quit your job without good cause, such as a compelling personal reason
    • Are out of work because of a work stoppage (except for lockouts) in the last 49 days that violated an existing collective bargaining agreement where you worked

  • No, you were not terminated. You quit. You are not able to receive unemployment. If so, I'd be quitting my job tomorrow.

    Here you go:

    A: By law, the unemployment insurance program provides benefits to people who:

    • Have enough employment to establish a claim
    • Have lost employment through no fault of their own
    • Are ready, willing and able to work and
    • Are actively seeking work

    If you worked in New York State within the last 18 months, you have the right to file a claim for benefits.

     

    You must meet the qualifying conditions set by law to qualify for benefits. (See list above.)

     

    We can only determine your eligibility to benefits after you file a claim and we have all the required information. We determine your eligibility based upon the New York State Unemployment Insurance Law and precedents of the Law as set by court decisions.

     

    You may be eligible for benefits if:

     

    • You lost your job due to lack of work
    • The temporary or seasonal employment ended
    • Your job was eliminated

  • I can't speak to your state, each has different laws, but I represented a firm where this exact situation occurred in California.  The woman quit because she wanted to work part time, the firm had hired her for a full time position and needed her full time.  She quit because she didn't want to pay full time child care. She was denied unemployment and continued to appeal the decision.  Every appeal was denied.  Again, I can only speak to California, but if you chose not to meet the hours for which you were hired because of childcare, you are not eligible for unemployment.

  • Sorry to be blunt, but quitting your job to be a SAHM is not a qualifying reason to get unemployment. Unemployment is meant for people who lost their jobs because of no fault of their own. I needed it when I lost my job to pay my mortgage and stay afloat.
  • You should have asked this Q before you quit.  You may have been eligible for Family Medical Leave.  But since you quit, that is probably no longer an option.  You may want to consult an attorney to find out if your state is one that required the employer to raise this option even if you didn't ask for it.  In light of the fact that you quit rather than got fired, I suspect it's a moot point.
