I hate lawyers - rant

Just needing somewhere to vent, so forgive my rambeling.

My In-laws died within a month of each other last year and we are using part of the inheritance to purchase a home. This will be the first house for DH and I and when we initially inquired about the length of the legal process, we were told that it would all be wrapped up the beginning of August.  We started house shopping mid July, found the perfect house, but had not yet heard back from the estate lawyer.  We contacted him and he stated that he just had to set up a date with the courts for release and it would only be a couple weeks. Ok, fast forward to today. Still hadn't heard anything (he was on vacation for THREE WEEKS!) so we called him again today. He said that he still hasn't set a court appointment yet and it will be at least another 30 days before it's all wrapped up. 

I know that we will eventually get a house to move into, but I'm making myself sick by wondering if the house that we really want will sell before this entire process is complete. We continue to look because I know realistically there might be something wrong with it that changes our mind anyways, but I feel like I'm almost giving the RA a run around with all this looking and nothing to show for it yet. How long did you look at houses before you made a decision?

argggg.. i hate lawyers! He doesn't have any reason that he'll give us as to what's holding him up from making the damn appointment with the courts. I think he's just lazy.  Maybe i'm just upset that the family decided to get an estate lawyer instead of us handling it all on our own.

  • Your irritation is totally legitimate.  Poor communication from a professional is the worst.

    But I don't think you actually can handle an estate on your own, or at least without quitting your job to learn all the ins and outs.  There is a ton of legal work to be done and it takes several months to close an estate.  But you did say "last year," so there may have been time.  But there could be legitimate hang-ups that he's just doing a crappy job of explaining to you.

    Here's my tip: set up an appointment.  He cannot ignore you if you're across a desk from him.  Bonus: to keep him from looking like an idiot in front of you, he'll actually do some work so he can tell you X is here, Y is this, Z is done.  So many people in the modern world forget about how quickly things can be accomplished face-to-face instead of waiting for a phone or email message to be received and returned.

  • It could be that he's not prioritizing your case, or it could be that he's waiting for receipts to come in from creditors that have been paid, waiting for the publisher's affidavit from the newspaper, waiting for banks or other entities to disburse funds to the estate, waiting for the probate judge/clerk of court to give him a time to come in, trying to settle debts, waiting for the final tax letter from the IRS ...

    There are all sorts of issues that can come up to slow things down.  Don't count your chickens before they're hatched.

    This. I'm sorry you are being delayed, but there could be (and in my practice, there often are), lots of factors which you as a client are not aware of, but can slow things down. KWIM?  Oh, and lawyers are allowed to go on vacation, too Smile

    Sure, they can take vacations and sure people can be understanding when issues come up to slow things down.  It's the lack of communication that is the big problem with most lawyers.
