Copyright question

I just made a Very Hungry Caterpillar 1st birthday invitation for a girl on another board, and one of the girls is saying that it's copyright infringement. 

I know I can't recreate or sell any of his work, but I downloaded the images off of another site (for free) and I'm not selling her the invitation, I did it for free...

am I doing anything illegal?

  • That means the invitation I made for Maggie's 1st bday for Krissy were copyright infringement.  I don't know the rules, srory!

  • I don't really know?  I think probably somewhere deep in the legal mumble-jumble it is a copyright infringement.  But I also think it is something people do all the time and as long as you are not making any money off of using the imagine I can't see anyone caring.

    I know for a fact that she is committing copyright infringement because she recreated them and is 'distributing' them... even though she's not charging. 

    I'm 95% sure that every 'hungry caterpillar' invitation on etsy is using this kit, because they all look very similar. Apparently one of the other girls made cookies with the caterpillar piped on top and she had her listing taken off once, along with everyone else with the tag 'hungry caterpillar'... no one had legal action taken against them or anything though.

    If you search etsy, it comes up with hundreds of listings, so I seriously doubt I would ever get in trouble considering I'm not selling them.

    Long story, chances that Eric Carle's attorneys are going to knock on your door  are slim.

    Meh. Actually, as long as you change something over 50% you can use it.

    KR's room is a Very Hungry Caterpillar themed. My mom painted pictures that look like the fruit and caterpillar.

  • Yes it is - but there not likely to come after you and even if they did it would probably be just to ask you to stop.   It doesn't matter that you got it from someone else's site (although she's probably guilty too). 

     I'd be very careful if you ever tried to sell anything for a profit with someone else's copyright.

  • As long as you are not profiting from this, you aren't doing anything illegal. On a side note I mentioned this to my husband to see if he knew anything about Canadian ip law and I found out that y'all have moral rights with your copyright too which is really nifty! Learn something new every day :)

  • IMO as long as you aren't making money on it then it isn't. Also... if the image was available for download I say you are fine.
