If you were pregnant and due the end of the month and recently arrested as part of a massive drug ring crackdown would CPS take your baby once you gave birth or would you be able to leave with it? This is assuming you give birth before the sentencing and you are out free on bail.
Yes this is an unspeakably awful situation.

I have no experience with this, but I would imagine CPS would be involved from the get go, but don't they normally look for relatives to keep the child?
They will most likely test the baby for drugs in the hospital and then CPS would most certainly be involved if the baby tests positive. This part, I do know of someone who was in that situation. They were able to take the baby home and then CPS showed up at their door 3 days later. The baby was put into the custody of the grandparents and the parents had to take drug and parenting classes and take regular drug tests.

I think as long as they are not in custody then they keep their baby. If you are in police custody/prison I think they have to surrender the child to CPS. Even if only on a temp basis, or give it to a relative with temp custody.
I'll ask my friends who work for the police department if they know.
If they have suspicions that the mother is under the influence at the time of birth, then they will most likely test both mother and baby. In the case of my cousin, she tested positive as did her baby. The baby was taken into foster care and she was remanded to a drug rehab program. She had a long list of things that she had to successfully do to regain custody. She never did, and later relinquished her rights, allowing her daughter to be adopted. That was about the one and only good thing that she has ever done.
My mom was given that option of trying to take the baby into her home, but due to geography and other factors surrounding my cousin, my mom declined.
This happened to my cousin. They both tested positive for marijuana at the baby's birth. Unfortunately, CPS never deemed it necessary to take her child away.
However, I am sure that if she's got criminal charges, etc. then CPS will be more involved (either relative or foster care).
