Wondering why the hell our agent hasn't told us what time to be there for final walkthrough tonight (since closing is at 8am in the morning)..

TURNS OUT THE FING SELLERS DON'T WANT TO SIGN THE PROMISSORY NOTE OF $800 TO CLOSE!!!!!
We already have the moving truck because TOMORROW is the ONLY day we have help and DH can take off work. He starts on call TOMORROW and he is not allowed to miss any days for the rest of the season or they reserve the right to fire him immediately.
I asked if we can do our closing tomorrow while they get their *** straight, and NO we have to close same day.
Apparantly now the sellers, are both unemployed and want to fight having to sign the freaking note.
REALLY!?
The house is packed, I don't even have any extra outfits out, because this was finally (THIRD TIME) supposed to be done and over with.
They would probably let it go to foreclosure before they signed the damn thing.

Our agent isn't saying a whole lot, except that they are working on it. The Listing agent had our agent call to see if we wanted to pay it. (uhm no, we're not rich, and it's not ours to pay, we already had to pay over $1000 just for well/septic because their water had lead in it, something that a normal seller would of had to pay!)
Our LO is pissed and he is calling LA right now, he said it needs to come out of LA commission, lol.
I'm so pissed right now.
They've known about it since 8/15/11. No, we can't pay it, we already have to pay a lot of other closing costs out of pocket, and I'm not going to deplete our savings because of their stupidity.
ETA: it's been on the market for over a year, I can see why it's a lot of money too, but they should of had this out with their agent before today.

Yeah but what are your other options? Either way you are going to be out money - whether you pay it or you have to cancel your moving, stay where you are longer, etc.
This totally sucks but I guess if they will not pay it - then you have two options ... pay it and get this over with or not pay it and what? Back out ... lose money and time either way.
I'm sorry you're going through this and I know its a huge frustration. I sincerely hope it all works out and you can close tomorrow afterall. However, what happens if they refuse to pay it? Do you see a realistic solution to get you to closing? Because it sounds like they are not in any way motivated to take care of this and if the sale falls through you will be out the money you've already spent on inspections, moving truck, etc.

I have to agree with the last two posts. It stinks, however, you are in a bit of a pickle. If you really want the house and they flat out refuse to pay, is it worth walking over $800 (and losing all the money you have invested in the home already--plus the cost of "limbo" while you wait?).
Don't get me wrong, I would be irritated as you-know-what if I were in your shoes, but I would also be planning to pay the $800 so that we could complete the sale and move forward in our new home.

Honestly, I'd be insanely annoyed. This sucks. BUT if $800 would deplete your savings, this may be a blessing in disguise. Who knows what other expensive things with this house may have been delayed/ignored.
At this point, I don't know what's going on. We did our final walk through, our our loan officer said our money is being wired first thing in the morning to bank of america, and our attorney has not called us. Apparently the listing agent hasn't called back our LO or REA with an update, and we were never told by attorney not to come.
They did draft something up saying that we can still move tomorrow if this doesn't get resolved until Monday.
It's not ours to pay, and that's why i'm not paying it. We aren't loaded like most of the people on here, We are low-medium income, because of P's heath issues/dr. appointments, I can't work FT, anymore. The house we are buying is not extravagant, it's under 900 sq feet, 70k.
Yes, we have owned a mobile home before and yes we pay home expenses now, and yes we know that stuff can break, but i'm not spending that much money because they are being morons. Our LO said if it's not straight by tomorrow they are in default on the contract, and that it needs to come out of the selling agents commission.
Our closing costs are already at 8k.
I completely understand what you're saying and I understand you're seeing red right now. I'm just saying that before you do anything rash and walk away completely, consider how much money (and time which you have to consider as an opportunity cost) you'll lose if you walk. Like PPs said, the costs of the inspection, paying for the truck you already have, etc. Especially since it sounds like if you walk away from this, you won't have another chance to move again soon since your DH can't take any days off to close in the future and.
I understand the principle of not paying for things that you shouldn't have to. I think everyone is just saying to be careful and be absolutely sure that you'll be ok losing this house for $800. Hopefully you can straighten all of this out. Good luck tomorrow!
Um... you don't have to be "loaded" to have $800 and not have it deplete your savings. And there is a huge difference between upkeep on a mobile home and upkeep on an actual house.

I understand the $800 is "not yours to pay" but would you rather close tomorrow or possibly lose this home for the sake of being right? In the grand scheme of things and compared to what you've already paid, $800 is a lot to lose a house over.
As for being in default on the contract, what does your attorney say?
Edit: I wasn't thinking when I said $800 was a lot to lose a house over, I meant, it was a small thing to lose it over.

Your lawyer, and only your lawyer, can actually advise you on your rights if they refuse to pay and default on the contract (Your LO is not who you want to listen to). All we are saying is that it is important to consider what you will do if it comes down to paying the $800 or losing what you have invested already. $800 isn't chump change (and I think it is wrong to assume that the majority of the posters are "loaded"), but it is only 1% of your overall cost. Maybe they can even roll it into the loan if it is that much of a hardship.
Bottom line...if they won't pay and you have a decision to make, is it worth losing a house (and over $1K) over a "horseshoe nail?"

Can either agent pay it out of their commission? Maybe if they split it? I am sure they are just as motivated as you to get this sale closed and get paid so if they had to take $400 less each maybe they would?
I'm only suggesting because our sellers (who weren't in financial hardship, they were just a$$holes, complained about only getting $X for the house and said they'd agree if both agents reduced their commission rates - - and they did!)

I totally agree. I would be furious if I had to pay it, but I would absolutely pay it to keep the process moving if it was the only option.
ITA. We got a notice of a tax sale due to money that we had already paid to the bank and the bank never paid to the town! I sure as anything raised hell about it, got our lawyer involved, etc. but I was prepared to pay it if it meant that we wouldn't lose our house to a bank mistake, and no we're not "loaded" TYVM. Needless to say it ended up that the bank paid it but you're really willing to walk away and lose all the money you've put into the situation thus far over $800? I'm sure you would lose A LOT more than just $800.
