The reason that the character is not back is that the actor decided not to renew his contract. The excuse they came up with is that Elliot chose to retire instead of submitting to scrutinizing of his role in the shooting that a PP mentioned and having to go through anger management.
Benson is definitely not dealing well, and I am loving this season so far (although I am of the camp that Elliot and Olivia were M.F.E.O., which makes the lack of Elliot sad). If you are hesitating to watch, I really recommend it. There's a new showrunner (Warren Leight, who was part of L&O: CI and also Lights Out on FX), and he is really revitalizing the show!
