  • Some of the comments were insightful - - how many pot posession cases did they prosecute, and is that worse than domestic violence?

    Is "domestic violence" it's own charge, or if a domestic partner hits you, can you be charged on a separate charge (assault, battery)?

  • I'm from KS and my mother works "for the state" (although, not involved in this decision), so I have an idea of what is happening.

     

    I am getting the feeling that bringing this topic up is meant to scare people into helping the government more: that they realize that no one is going to care enough about the government's money problems until they hear about a possible (and terrible) ramification.   I highly doubt that it will actually pass.  I bet the goal is to get people to open their wallets.

    Is that why people have been getting released without charges being filed?


    Since the county stopped prosecuting the crimes on September 8th, it has turned back 30 domestic violence cases. Sixteen people have been arrested for misdemeanor domestic battery and then released from the county jail after charges weren?t filed.

  • October is Domestic Violence Awareness Month.  Maybe we need to go make them aware?

    This is disgusting to me.  DV victims already have a difficult enough time getting help and support without the law turning their backs on them.  Assault and battery alone don't seem to address the issue and I'm not sure why.

  • I can only hope that this is enough to make every woman, or at least most, move out of the town, maybe even the state to get away from this bs. Decrimializing Domestic abuse... what's next? Decriminalizing manslaughter, or DUI's? It should be a higher charge for DV. Sometimes a misdemeanor for some of these abusers is like a slap on the wrist.

  • This is infuriating.

    If DV is such a burden on resources, it's because of the abuser. This type of reaction rewards the abuser and punishes the victim. Disgusting.

    As part of my job, I read police reports a lot and there are a lot of DV calls. Many of them are to the same addresses over and over and the arrested persons are repeat offenders. If you want to cut back on the expenses of DV cases for the courts, harsher penalties would reduce the frequency of calls to the same address and cases with the same defendants over and over because they would be behind bars.  By letting them out with charges dismissed, you send them right back home to do it again and end up in your court room again next month.

    I have a small bit of insight from working in the criminal courts and having a friend that prosecutes DV cases (she's pretty much a rock star to me).  I'm in MI, but I suspect the laws are similar.  

    A person can be charged with A&B for a DV case, but here is the rub:  when you are convicted of a misdemeanor DV crime, it counts for any subsequent DV convictions.  For example, you have one DV conviction that is a misdemeanor, then you acquire another one, the third misdemeanor offense is an automatic felony.  Now, those are just for misdemeanor DV charges.  DV can rise to a felony just on one instance, depending on the severity.  That would depend on what the statute says. 

    A&B is different in that you can get as many misdemeanors as you want (so to speak) and they don't "accumulate", so to speak.  So, a partner can be assaulted numerous times and if it's not to the severity of a felony, they are all misdemeanors.  

    Did that all make sense?
