I came across this article after a FB friend posted it.  I'm not sure how I feel about the bartender/waitress posting all that on FB and The Stranger posting an article about it.  The guy was a straight up douchebag, but I'm not sure he deserves such media-driven attention. 

Legal people:  Can the waitress/The Stranger get away with this?

  • A friend of mine had this as well and all I could think is "don't people have better things to do with their time."

    That being said his comment does make him a douchebag. However tips are for good service, so if he didn't feel the need to leave one, so be it..but the comment wasn't necessary.

  • He was a douche and her response was douchey too.  Posting true facts all over the internet is not illegal, but if she took info from his credit card/receipt, I'm not sure...maybe there could be an issue.

    I was thinking the same thing. Posting true facts aren't illegal. However, there may be some underlying privacy agreement/rule regarding information on a credit card slip.

    ditto everything and I'm also wondering about this.  I mean, there are laws about slander right?  So I imagine you can't just go posting personal info about people like this, but who knows.  Plus, even though it doesn't make what he did right, what if she was really mean/bad service/etc?  And clearly she isn't below doing something mean herself...

  • From what I read on the situation, the douchey thing she did was suggest he get a double decker taco instead of just a single taco since he was apparently drinking (and the double decker soaks in more alcohol I guess?).

    And then, when the itemized receipt came, he crossed out the original total, and put in a total about 2 dollars cheaper, and she ran the credit card for the original total and returned it which he copied down and signed.

    I mean, two sides to the story and all, and I'm all for not tipping if the service sucks, but stealing tips from the tip jar (I don't know if it was in the Stranger article, but he emptied the tip jar into his pocket), and then leaving unsolicited 'advice' is probably more douchey.

     

    Also re: getting away with it legally? The Stranger wasn't the first internet outlet to break the news. It made a more national reading audience with Jezebel first I think, who picked up the story (I /think/) from a tipster on Facebook. And it made its way around Facebook, so I imagine the legal ramifications get murkier; I can see Victoria's facebook account, but I'm not sure if it's public to everyone (or just people in her networks, which includes Seattle) or what. (Edit to add: Just checked, her facebook account is completely public - so it's not like venting to friends.)

    what??! he emptied the tip jar?! that is beyond wrong!!

    i agree with all the pp's...what he did was wrong, but what she did was absolutely wrong, too. i think she might actually be *more* wrong, by posting his personal info online.

    btw: this was also posted on somecards fbook page (where i first saw it), which is another major audience, i think.

  • I don't think it qualifies as full on slander since the douche's full name wasn't released, plus if he did empty the tip jar, he would be on the line for theft.  As for the attention, well, IMO he kind of asked for it by writing it out.  Basically if you don't want others to know about something, don't leave proof.  It's like the Dimitri guy with the phone calls - he dug his own grave by leaving those messages.
