What do you think about this

Found a house > went through inspection > submitted request for repairs > seller agreed to repairs. Escrow supposed to close by 10/14/11. Seller leaves town for a vacation, will not be back till 10/15/11. Calls us to say house is completed, then he leaves the country for a 2.5 week  vacation. Go on walk through. All repairs not completed and won't be by the time he gets back. However, many are. In addition, the house is an investor flip and left over construction materials are still in the garage. Another factor is that the seller said that the house will come with wood shutters that he claimed were in satisfactory condition. They were raveled up in a  corner of the garage while construction on the property was occurring. Seller claimed all they needed was a good cleaning and they're ready to hang. During walk through, we unraveled/inspected them for the first time. They're junk. Some missing and broken pieces and at least one piece of the set not there. Same day, appraisal comes in at $500 less than purchase price.

We were ready to walk away on the grounds of repair and appraisal contingencies. However, realtor convinced us to give seller a chance to make good when he gets back. We are asking for the items he originally agreed to do to be finished and in addition, are asking him to purchase and install shutters in the home on all windows that had them previously. We believed we were getting a house with shutters and therefore want a house with shutters.

First time home buyer. Am I being realistic? I am pissed off that the seller is that confident in himself that he leaves town with the house unfinished. He is someone I already know and I think he believes because of this he can be lax with me. However, for this amount of money, I mean business and want to be taken seriously.

  • It shouldn't matter if you know the guy or not. I agree with you: business is business. If he agreed to make repairs, they need to be made. He also should clean up (that's just common sense). The end. I wouldn't stress about the shutters too too much because they aren't that expensive but again, if you were promised shutters you should get shutters. It's not being petty, it's what was (I assume) in the contract (written or verbal). You are spending a lot of money on a home. If you aren't in a huge rush to move in I agree with your realtor to give him a chance to make good when he gets back and if he can't do that he doesn't deserve the profit from the sale.   • I agree. You should only pay for what you thought you were getting. A house isn't something that you can return if you decide you don't like it after a few days, so make sure it's everything that you've wanted and everything that you want to pay for. I don't think your requests are unreasonable at all. If he agreed to make the repairs, then he should make the repairs. Someone else that comes along is most likely going to want the same things, so he's just loosing money the longer it takes him to make them.  Wishing you the best of luck!

  • Personally, I would not ever buy a house that I knew was a flip. It would have to be a very special circumstance. Seen too many of these shows and heard too many horror stories about the shotty work that is done. 

    Everything that is shotty that you can see - times that by 10 for what you can't see IMO. 

    But I guess you are on this path - so you have your choices and they all come with consequences (whether it is financial for walking away ... or time/risk by continuing forward with allowing the seller to fix their *** when they get back, etc)
  • If you really love the house, I would give the seller a chance to make it right. Obviously the price will have to come down anyway, so either have him actually complete the repairs, or take the price down even further so that you can do them yourself.

  • I would ask for the cash up front for YOU to take care of the needed repairs/changes.  That way you can control the quality of work.
