am I a freelancer?

I recently started working for a businessman in my area as his personal assistant.  I balance his books, do some paperwork for him, light errands, etc.  We live in VA but he has a company that runs out of TX.  He told me to just email him an invoice of my time and he would send it to TX and they would pay me.

So I guess I am a freelance employee, right?  Is there anything legally I should do?  Create a company or do I just make up an invoice and send it to him every month and do my taxes based on that?  I will probably make less than $5K with this guy but eventually would like to branch out and be a personal assistant for multiple people and make more full time.

  • Did you fill out a W9? If so, you're a freelancer and you'll get a 1099 at tax time. If he's asking for you to invoice him, it certainly sounds like freelance work to me! Just make sure whatever rate you invoice at is higher than what you'd expect your hourly rate to be if you were a regular employee because you'll be paying a bigger percentage at tax time. You don't need to create a company, although you certainly could. I do freelance work, but I'm just an individual and didn't go through with forming any sort of business and have been just fine at tax time :)
