Our lease is up on November 30. We had decided to stay in our little one bedroom that we love for another year. We got a letter the other day saying they were raising our rent by $80 (not including our pet rent fee and our storage unit fee - another $30). Last year when they did this, we are able to mention it to them, and they brought it back down. When we went in today the chick said she didn't have the authority to do that - we have a new property manager, so I guess that's legit.
Anyway, it sounds like we're going to end up paying this extra $110 a month for our 1 bedroom if we renew. They require a 45 day notice to vacate, and we didn't do that because we didn't realize they were going to raise our rent. If we had known, we would have done that. It's not that we can't afford it, it's just that we don't feel like paying over $900 for a 1 bedroom in a complex that, despite how much we love it, isn't really that well maintained.
We considered going to a 6 month, but then it's an additional $80 a month. So, regardless of whether we stay for a year or just 6 months, we'll be paying basically the same amount.
We are going to talk to the property manager on Monday, but this is kind of ruining my weekend. I was so set on staying where we are, and now I don't know if we can get out of it w/o paying a large fee because we didn't have a notice to vacate. But how much can they really charge us when we haven't signed a lease for the next year even though we didn't write a notice to vacate?
I'm so upset. I feel so stuck!

At my complex in A2 if you have not signed a lease or send in a notice to vacate you default into a month-to-month lease and they charge about $120 more per month for a one-bedroom loft. I'd check w/ your manager on Monday- because if it's the same cost to pay mtm as it is to re-sign the lease, you might as well go month to month and look for a new place to live.
If you're staying in Ann Arbor, you might be able to find some reduced rent "deals" mid-season since there won't be a lot of move-in-ready renters around town.

As far as I know, they don't go month-to-month. From the letter, it sounds like they default you into another year-long lease but you have to pay around $1300 a month - ridiculous! I'm not for sure though... We'll talk to the guy on Monday. I mean, I guess $100 a month isn't THAT bad when you consider the cost (financially and stressfully) of moving... we just feel taken advantage of

So, your rent will go up $80 if you re-sign for a year or if you re-sign for 6 months? If that's the case, I'd resign for 6 months and use the time to find something that you feel is a better buy for the money. It does suck that your rent is going up so much, though.
If you feel like you should go somewhere else, do you think they'd be willing to work with you at all about giving a less than 45 day notice since you didn't know the rent would increase? It's kind of shady to me that they didn't let you know that in time.
We re-signed at our complex back in May and just in mid October (we got new jobs and wanted something bigger than 550 sq feet!). All we had to do was cover our rent until someone new moved in. The complex has a waitlist, so all we had to cover was half a month's rent before someone new moved in.
I would question the legality of the fact that you were only informed of the rent hike after the 45 day point. If you didn't receive the notice prior to October 17th then they didn't even give you any time to consider this option. I would without a doubt bring this up in the meeting because to me it seems borderline illegal. By no means am I a legal expert though.
I would only sign 6 months like PP said and look for a new place to live in the time you get. Good luck. Let us know how it goes.
This is what I was thinking too. If they require you to give 45 days notice then they should be required to give at least 45 days notice of a rent increase though I would think more, so you would have time to find another place.
I would definately look into the legality of it, especially if the property manager gives you a hard time on Monday.
Thanks ladies! I'm feeling a lot better about this now that I've slept on it. We'll chat with the property manager on Monday, and hopefully he'll just lower our rent or let us get out of here.
Just to clarify - it's an extra $80 for rent but if we sign a 6 month it's an additional $80 - so a total of $160 more/month - basically if we sign a 6 month we could leave, but we'd really be paying more/month BUT not as much as I calculated last night since I was tired and am bad at math... lol...
Yeah, the legality of it when they don't tell you they are hiking up your rent before the 45 day notice period is shady ... I'll give you ladies an update after we chat with the guy.
