Re: Couple Jailed, Daughter Taken Away, Over $5 Sandwiches

  • They should have been arrested for naming their kid Zophia.

I agree though, there must be more to the story.

  • Yeah, there is a lot missing here. Typically there is an emergency placement hearing to determine if there was cause to take a child into protective services (and usually parents would have a right to be present and there has to be an absence of any alternate care options like a friend/family member in state that could take the child).

If both parent were arrested at the same time (and the store managers would decide to press charges or decline, most loss prevention departments simply trespass the person if they make restitution on the spot, but they are within their rightss to press charges for anyone stealing) and the parents couldn't offer any alternate care options, I don't see how they have a lot of choice but to take the child temporarily. Once they do, they have to wait for that emergency hearing that takes a day or two to get scheduled/executed, before returning her.

  • Pretend like my grammar wasn't terrible there. The point is that I don't think this was a huge miscarriage of justice I guess. If it were my call to make, I'm sure I would have declined to press charges, but for grocery stores, that's a huge source of loss that they have no other real options to combat.
  • OF COURSE there is more to this story. The Huffington post is well known for being as dramatic as possible.

    I totally agree.

  • I get where the store is coming from but you can usually tell if it was someone really trying to get away with something or they were just distracted. I'm also sure if the mom was as mortified as the story reads the store manager would have been able to pick up on that, so that seems to me like a little bit of a power trip. On Yahoo I saw they were thinking about suing the store. If she sues the store over this and wins I think that would be even more wrong. Two wrongs dont make a right...
  • Well I would bet all my monies that anyone caught stealing would pretend to be mortified/indignant and pretend that they just forgot to pay.  That shiit happens every single day.

The fact is that they stole from the grocery store and were arrested for it.  I'm not sure how they could possibly win a lawsuit against the grocery store for agreeing to press charges (it's not like the grocery store arrested them or took the kid away, those were legal consequences of breaking the law - all the store did was turn them in for it)
