Meeting w/ lawyer....

Just scheduled my first meeting with my divorce lawyer. 

What should I bring to that first meeting?

What is generally accomplished?

  • It depends on your situation.  If you're going to file papers, then you need more info than just if you're going to find out info on how to protect yourself.

    To bring--copies of financial records, last year's tax forms, insurance infomation (I needed this in my complaint for divorce) but a lot of info can be gathered after the complaint is filed.  If there are police records (if you're trying to get a restraining order) then bring those but I don't think that's your case.  You'll likely need tissues but most family lawyers have more than enough on hand...

    Accomplished--depends on what you're going there to do.  You can get advice on how to protect yourself financially (my lawyer told me to leave, go to the bank, take out money and open my own account), whether leaving the marital home will strip you of rights to property later on, options for finances, whether there is a separation period in your jurisdiction, custody, spousal support, etc.  If you want to file on the spot, they can start you on doing that.

    Ladies with kids can help you more on this end..personally, I walked into the lawyer's office with nothing but some rudimentary knowledge of our finances and a credit card for a retainer and filed divorce papers on the spot.

  • After I was served, I just brought those papers with me and after we met, the lawyer told me what he needed.

  • Yep yep, Mint is right. All you need are tissues and a credit card to pay the retainer. Then your lawyer will tell you what he/she needs for your specific case. Also a good idea would be to write down some concerns/questions to ask your lawyer. Especially if they charge you for the initial consultation, you want to get the most of it. Good luck!
