my house isn't for sale, but it kinda is...strange question inside!

DH and I can't wait to be able to move out of our current house so that we can move back up home. Even though this is probably at least a year away, I'm on realtor.com pretty regularly just to do some initial "research." Last week, I typed in the name of my current housing development to see what houses are listed for in my development. Imagine my surprise when I see MY HOUSE listed for sale at the very top of the page!! There wasn't an address listed, but the picture was of my house when I bought it new 3 years ago. I live in a kind of cookie-cutter neighborhood, so other people do have my house, but I know that I am the only one to have that specific elevation and color.

SO...I filled out one of those requests for more information. Got a reply the next day from a realtor who told me the address of the house and asked if I was interested in setting up a walk-through. She does not know that I really just asked for more info because I saw a picture of my house for sale. Now that I had the address, I drove past the house yesterday and see that the house is the same model, but a different elevation and a slightly different color (different shade of green), so the house for sale doesn't look anything like my house!!

Given that I am planning on putting my house on the market (or renting it) within the next year or so, I am not very happy to see someone using a picture of my home to sell another home. I haven't replied to the realtor because I don't know what to say...any ideas?? Is it even legal for them to use a picture of my home?? I wouldn't think so...

  • This is so easy. Just email the realtor. I'm guessing it was just an honest mistake, because they have nothing to gain (but a lot to lose) from using the photo of your home.

     

    "Dear Realtor,  I wanted to make you aware that the photography company must have accidentally utilized the wrong picture for your home for sale at 123 Mockingbird Lane. The home in the photo is actually my house, which is located at 214 Melody Lane. Please remove the photo of my home, which is not for sale, and replace it with the correct one. Best, 062307Bride"

  • If the other home is a new construction and it is the same builder that built your home, then I think it is totally acceptable that they are using the picture.  Your home is their "work" and they are giving an example of the work.  I think what they are doing is very common and really not a big deal.

  • As long as they've blacked/blurred out the street numbers on the house (and also aren't giving out your address in any way), this isn't something I'd care about.

    I would be annoyed as a buyer. I want to see the house in the picture; unless the ad says 'similar to be built'

  • Maybe it was intentional, maybe it wasn't. When I was house hunting 3 years ago, I ran into this a few times where the house in the picture wasnt the one the address belonged to.

    The other house was built about 2 years ago, so it's been around for a bit. You can't see the address on the house, but it annoys me because my house is the only house in the development with that elevation and color combo - plus, there are so many more differences between the two houses - the other has a lake behind it, their driveway is a downward slope whereas mine is on an incline - so there are other things that potential buyers would want to see.
