I gave one month notice (more than required) to my job and my last day is tomorrow. I do home health visits as an occupational therapist.
I begin a new job Monday in an outpatient clinic 40 minutes from my old job, and due to dropping off/picking up my child at preschool I am unable to get back into my old office during business hours.
I received an e-mail from the company owner (not a practicing therapist, but an attorney) today telling me that they will be concentrating on all of my old charts by doing audits and I am expected to make any corrections to notes next Friday "when you pick up your paycheck".
I'm unable to go in to pick up my paycheck. My work hours don't let me. I have told them this before, when I discussed staying on to keep a few patients who live near me.
I have worked at 5 home health agencies in my career and have never had one tell me 1. I couldn't leave without them making me "correct" (i.e. you didn't dot your "i"s and cross your "t"s) notes. When it was my last day, it was my last day. or 2. be so incredibly anal about every.last.word. you write. They audited charts and you had to supply missing information within reason.
It would be one thing if they did these chart audits and had everything ready for me to do this week before I left, but they are just STARTING these audits today. And they are holding my paycheck until I can get them done - which I can't.
Can they legally hold my check when I technically don't even work for the company anymore?

You may also want to check with your state's department of labor if you don't get that paycheck.
Thanks for the link - I'm not sure if CO requires immediate payment. I am just pissed that we don't have direct deposit. And of course we NEED that paycheck ASAP since I won't have one from the new job for 3+ weeks.
I mean honestly, what if I was moving out of state or something like that?

This. They don't get to force you to work for free after you quit. Asking a few questions here and there is one thing, but what you describe seems much more time intensive. I would send the email above, and if they don't provide your check contact the DOL.
I also checked on the final paycheck laws in CO, and they are just required to pay you on the next regular payday, and are not required to mail it to you.
Isn't the paycheck for work already performed, not for future work?
Do what PPs said, because then you have it in writing.
If they are not required to mail you your last check ( as someone previously posted) how about giving them a self addressed stamped envelope?
