US embassy form question

So I am filling out some forms for babyMadrid's citizenship and am wondering if any of you can help me out with the sections of forms where I have to list precise periods of physical presence in the United States.

For those of you who have encountered this on a form before (any form for the embassy) do you know if this means that I have to list EVERY single time I have been in the US?  It says any trips out of the country don't count so does that mean I have to list my trips to Europe and Chile as a teenager too?

I will probably email the embassy to be sure, but thought I'd throw it out there for you ladies because I feel like someone mentioned this before.  TIA!

Re: US embassy form question

  • I would contact the embassy to be sure but I know that I have to deal with the physical pressence test when I have to do my taxes in the States. The IRS told me that they are different ways to look at residency and one way is the period of time you spend in the States. I think if you spend more than five weeks (I am not sure the exact time) then you could be considered a resident of the States.

  • Really?  Five weeks total in one year can make you a resident?  Huh...interesting. And good to know for whenever I have to file taxes...ugh, that's something that makes me dread starting working here.

Luckily that doesn't matter for this form, but it sounds like I have to list every trip to the US and every time I've been there for my whole life regardless of length of the stay.

  • I filled out every single trip I had made, and it was really really annoying. Especially since they give you 3 slots. Confused So I attached a form like they said, but honestly, the woman checking the documents didn't even look at the list. She looked at my transcripts, highlighted each year, came to a total of 5 years physical presence (not sure how she did that since my BA transcripts only cover 4 years and one of those was an exchange year abroad... but I wasn't going to point that out to her), and didn't look at the rest of the stuff.

  • I don't have a kid and haven't done this before so take this with a grain of salt.

Since they only need to verify residence for a certain number of years I would put Birth-year moved abroad.  I wouldn't put down trips taken outside of the country prior to moving for good because 1) I was domiciled in the US and 2) there is far more than the 2 year requirement there (although my H is American as well so our residence requirement is lower than yours)  and it doesn't appear to be worth the headache.

I am fairly certain this is what I did when we went for ds.

This is definitely what I thought should be the process, but the description of how to fill out the form says that studying abroad and vacation outside the US count as being out of the country so that confused me.  However, it seems unlikely they are going to take the trouble to look at that and my transcripts will establish 5 years residence there for sure so maybe I won't list them...I think I'll send an email to the embassy asking just in case.

    Thanks for the input!

  • I think it depends a bit on your particular embassy because I wrote my dates down as best as I could remember them, and used my passport as a guide, but they didn't control that section of baby C's form at all.
