NLers - RE: my darn security deposit

We moved out of our apartment JULY 14.  It is now November 16 and we still haven't received our security deposit back from our landlord.  We checked out on July 14th but didn't actually leave it until July 15th.  The landlord knew we were doing this and agreed to it so we still had a bunch of stuff in the apartment (mostly trash because trash day wasn't until the 15th so we couldn't dump it on the curb until the 15th AND out suitcases).  During the check out, there was a bunch of stuff they wrote down us owing (like we didn't pay to have it professionally cleaned we just did it ourselves, we didn't dry clean the curtains and the walls needed repainting from a certain toddler painting the walls with food - they were also blaming us for mold in an unventilated bathroom but our makelaar said he was going to fight that one).  We signed the paperwork and they left.  I asked the makelaar if that was it or if they were going to come back and look again for more stuff wrong.  He said that report we signed was final and they couldn't come back after us legally.

After we left,  they contacted our makelaar and said that they went back into the apartment and there was a lot more stuff wrong with the apartment that we hid from them and they were very upset with our dishonesty and they wanted to a re-do.  Our makelaar and husband's company are fighting this because technically the lease is in husband's company's name but it is our security deposit (which husband's company paid so if we did owe anything on the apartment, we would have to pay husband's company).

Anyway, we're not getting a lot of info from husband's company and at this point, I just want to be done with it.  Does our landlord really have a leg to stand on?  What is the timeline in which this needs to be resolved.  I would have thought 4 months would be plenty!!!

  • I have no advice for you, but I really hope we don't have to deal wtih that crap when we leave.  Oy!!!  Good luck!

  • Thats so disgusting I can't believe they were allowed a redo. I really hope it gets sorted quickly.
  • In theory your deposit should be held by a third party company from whom you can dispute any charges. At least in that's the case in the uk. I'm sorry your going through this.
