We just found out after failing our home owners insurance inspection (and getting termination!) that we need a new roof.
Our home inspection said our roof was 5 years old, and in great shape, we called him and he still says the same thing.
I had a licensed contractor out here today who says it needs a new roof.
Obviously if we knew the house needed a new roof, we would have either a. asked the bank for the money (short sale) or b. NOT BOUGHT IT!
Does anyone know what our legal options are here?

That's what I figured but our RA said he should have to pay for it, so I was just wondering if anyone had had something similar happen.

Your HO insurance company dropped you over a roof or am I misunderstanding your first sentence? If they did, that is awful--I have never heard of that happening before.
As for the question, I think you would probably have to prove that the inspector intentionally lied on his report in order to have financial recourse against him.

You shouldn't have relied on the home inspector to tell you the age of the roof - that information is verifiable and should have been obtained from your sellers. I don't blame you for being upset if the inspector said the roof was fine and now you're learning that it's not, but these things do happen. If it's been a short period of time since the inspection (i.e. there's no way a storm damaged the roof since then, etc) you could also consider filing a BBB complaint against him if he's a member.

I would get a second opinion on the roof. We had an insurance company say they cuoldn't insure us because the roof was in bad need of repair. We knew it was is good shape, so we had a different insurance company come out. They walked the roof, and didn't see any problems, so they insured us.
Unless you know the roof is in bad shape, I would go with a different insurance company versus replacing the roof.
Sorry, I forgot to look at this yesterday evening after I got home.
We had our inspection after the hurricane that hit this summer, but we were no where in the path of it. No major storms/winds since his inspection, either.
We have had our HI (homeowners insurance) since we closed on 9/30/11 and our agent called last Monday saying they were terminating our policy on 1/8/12). They had sent out a 3rd party inspector who said we needed a new roof. I asked her if she was referring to the 6 broken shingles and she said no. I called back later and asked her if we just reshingle the house would that work, and she said no, plywood and everything was necessary.
Can you even make a claim just because your roof is old?
So anyways, I am hopeful that the new guy won't actually go up on the roof..but I had a contractor out yesterday who said we do need to re-do our shingles. But that the plywood was still great.
Winter isn't the best time to do this, nor do we have the money yet, so I am hoping we can get new insurance (albeit more expensive) and take care of this in in the Spring.
The sellers didn't cooperate with us at all, on anything, and it was a short sale. They had only lived here a couple of years so I'm not sure they would even know.
Unfortunatly at this point its probably to late to do anything about it, but next time choose inspectors who will write extended contracts for you. Our inspector has said that if anything they rated as satisfactory becomes a problem in the next 6 months, they will pay up to 5000 to fix it. However if they rated that it could potenially become a problem, they wont fix it, its up us to take the risk. Also if they make recommendations and we dont follow up on any one of them, they wont fix anything either.
