Help me figure out which POA I need

DH has his 1st deployment coming up.  I am going to make an apppointment with legal so we can get wills/POAs.  I will be getting a general POA, but I heard that it is also smart to get specific POAs as well.  Help me figure out which ones I need...

  • All the bills/loans/car are in my name.
  • The only thing in his name is our lease for our rental house
  • Our baby will be born while he is gone.
  • I don't work and will likely be going home during the deployment. 

I think I need a POA to put the baby in DEERS and make changes to my DEERS, I also may rent an apartment while I'm home (not sure yet) so I will need something to be able to use my DH's income and have the  lease in his name (since I don't work). I am also thinking I may need some type of POA to resign our current rental lease (he will be gone when the lease is up).

Am I missing anything?  Do I need to prepare anything else before legal?  We both know who would get custody if something happens to us and we also plan to put what type of funeral we would want if either of us die.

  • Are your wills up to date?  Has he recently made sure his SGLI is up to date?

    Will you be getting his taxes done while he's gone?  The IRS has a POA form on their website for that, doesn't require a notary.  It may also be a good idea to have a POA for Finance in case you need to make pay inquiries or adjust allotments, in case he doesn't have access to MyPay or a Finance office while he's gone.

    Neither of us have a will. His SGLI is up to date (but I'll be sure to have him check it out). Thanks for the rec for the Taxes and POA for Finance.  I'll be sure to include that on my list.

  • I'm sure your doing this for planning purposes, but don't forget the people who draft the POAs generally won't steer you in the wrong direction.  They know what Finance and DEERS and Tricare, etc, at your particular base will want.  I'd trust them. Wink

    Thanks!  I have never done anything like this and didn't want to walk in there blind. Will they only do a will for DH or will they do one for me (I'm really only thinking I need something in writing about what would happen with our daughter if something happens to me and he is gone).

  • You can (and likely should) get a will too.  It's best to talk to a lawyer about that.  Although your child hasn't been born yet, they can usually include wording about how you'd like your property divided amongst any future children, so your butt is covered in case you don't update your will immediately upon birthing a child.

    Call the legal office and ask if they have walk-in hours or if you need to schedule an appointment.  OR, see if they have hours advertised on http://legalassistance.law.af.mil/content/locator.php

  • Two weeks before they left, H's unit took care of everything. The guys had checklists. H's unit has a SSgt who is a notary, and they have this fantastic special POA packet. It's the bomb. Every special POA you can think of is on there, plus we added a couple in the blank one. 

    Just slow your roll a tiny bit. His unit will make sure he does this before he leaves. Have him ask them. 

    I've seen a lot of military surprise homecomings. It wouldn't work on me. I always have my back to the corner and my face to the door. Looking for terrorists, criminals, various other threats, and husbands.
