giving two weeks notice- update

 I gave my two weeks notice a few weeks ago before Thanksgiving and told my employer that my last day would be Dec 9. On Nov 30th, they called me into the office and released me. The HR woman said that she would pay me out 2 weeks vacation. I told her that I didn't think I had vacation and she said that I did and then escorted me out of the building. 

Anyway, I left and started my new job this Monday. Yesterday, the HR woman left me a voicemail and said it was a mistake. They would not be paying me anything. I'm really angry, because I would have filed unemployment for the days that I wasn't working.

Would you file a complaint with the state?

  • You were only unemployeed for 2 weeks? Count your blessings.

  • Depending on your state, you often can't file for unemployment if you quit.
  • No.  Once when I gave my two weeks notice, my boss said that it's his policy that an employee's last day is the day they resign.  He told me to wrap everything up that day and to pack up my stuff.  It didn't even occur to me to file for unemployment, given that I quit my job and it was only two weeks of not working.  I enjoyed my time off and then started my new job.  No biggie.
  • I don't think you'd qualify for unemployment since you resigned. What happened isn't uncommon. I've only worked out my full 2 weeks once.

  • Still you should of got paid they did state that you were gonna get paid vacation.
  • I don't see what state you are in and the answer will depend on the state you reside/work in.  As a general answer, you can claim unemployment if you put in two weeks and they released you early.  You will typically only get unemployment for your "notice time".  Since you only had 9 days left if your state has a week waiting period I wouldn't even bother applying.  If you do not have a waiting period there is no penalty for applying and not being approved.
