MCC

How does a Jewish divorce work? You have to get a whole separate divorce because you are both Jewish? Do they like, keep records of that so if you don't get the special Jewish divorce they won't marry you again? I never knew there was such a thing as a separate religious divorce!

Re: MCC

  • Yes, that's exactly what it is.  When you're both Jewish you sign a Jewish marriage contract, called a Ketubah.  To get divorced, you need to get Jewish divorce, called a Get (confusing word I know). This gets filed with the Jewish marriage gurus called the Beit Den who keep a record of who is married and divorced.

It's really only a big issue with Orthodox Jews (which I am not) but it's the last string tying me to XH and I'm insisting on it.  I can't get remarried to a Jew and sign another Ketubah without getting a Get.  It's like an Annulment in the Catholic Church except it doesn't invalidate the marriage.

  • Do women only need these or do men need them too?

Both. It's very antiquated in that the man needs to grant it to the woman.  There are a lot of issues with men who hold it and won't grant it and so now there is a big movement against these men (typically in the Orthodox community).  Rabbis and community members gang up on these men, protest outside of their work, harass them, etc until they grant the Get to their wives.  Without a Get, a woman cannot remarry or cannot have another relationship. If she does so with a Get, she risks being shunned from her community because she is technically an "adulterer" and her children will be shunned as well.  Thus, the movement against these douchebags.

    It's crazy!

  • Wow! That is intense. Is he going to be compliant and grant it to you? Man that would drive me nuts. I can't even imagine having a man hold something over me like that you know?

As you already know, he was compliant.  In fact, before we got married and signed our ketubah, we signed a document stating that if he gave me a hard time with the Get, that the Rabbinical Counsel had jurisdiction to adjudicate our case.  In other words, he agreed to let me fight him for it if he refused to give it to me.  Thankfully this wasn't an issue but oh, I would have LOVED for super religious Jews to picket outside of his work!
