Landlords/RE's please come in.

The tenant in our townhome is waay late on rent. The thing is that she tends to be late. At the middle of the year she gained our confidence back by paying on time and with cashiers check, because her checks would bounce.  This month however, she let us know that rent would be late, that we should have it by the 15 and she even did the math for the late fees. We told her we appreciated her honesty and that we would await her payment. Well now, it is December 17th and no payment. DH and I plan to email her and text her to let her know that we have yet to receive her payment and that she is continuing to incur late fees. However, how do we let her know that this late stuff business is unacceptable?

  • Tell her.  Send her a demand letter.  Outline the consequenses of not paying on time and let her know what date she can expect to be evicted for nonpayment.  There is no "nice way".  This is a business relationship.  You need to be firm and put everything IN WRITING.  I would also tell her no more personal checks. Cashiers check, cash, money order, or direct deposit into an account you set up for rents.
  • I am curious as to if she has explained to you as to why she has trouble paying on time. Is it because of the way her pays are set up, her spending habits,etc. I know none is an excuse, but if simply changing her due date to the middle of the month vs the beginning could make the difference that may be an option. I know for us when we first moved down here it seemed all our bills were due the 1st 5 days of month and it really strapped us. Some companies will change your due date if you request it. Just  some thoughts from the other side.

  • Thanks B! We sent her a firm email and received her payment about an hour later. Your response reminded us that, yes, this is a business relationship and Mr. Nice Guy doesn't always win. So, thanks for that.

    Rae- she has never provided an explanation. DH and I have talked about what other ways we can work with her but at the same time, she is not always truthful so who it makes us not want to work with her, ya know?  We don't like to be the bad guys and would definitely change her due date if requested but she doesn't give us much info when late.
