Antother lease question

I moved out of my office at the beginning of December.  I was told by the space manager that the owner always charges a flat fee for re-painting and that I didn't have the option of doing it myself. Lovely.   My old office is now the day use office and I have used it numerous times since vacating it.  They haven't done anything to it.  No painting, no nothing.  Nail holes still exactly the way I left them, etc.   If they withhold a repainting fee when I get my deposit back can I challenge that since I know it wasn't done?

Re: Antother lease question

  • I know I would even if you "can't", the worst they can do is say no.  Nothing ventured nothing gained as mamma would say-GL!

  • Under CO law, I think the landlord has to prove why they kept the amount and for what reason.  Therefore, you should probably just ask for the fee back since they did not use the deposit for the reason stated.  They only have 30-days to use/give you reason to keep it I think so their procrastination at painting might work in your favor.

Like D said, "doesn't hurt to ask."
