And the waterworks start again...

I opened up my email this morning and was very surprised (and happy!) to see that my attorney emailed me the Property Settlement Agreement and Complaint for my review before he files and serves it on my stbx.  I was elated until I actually opened the Complaint and looked at our last names in the caption ?then I couldn't even read the first line without breaking down. :(  I am a mess now? I don't regret this for one second, but its still not easy!  I can't wait to get off this friggin rollercoaster of emotions I'm on! Sad

  • That's great, but why is your atty drafting a PSA before filing the Complaint for Divorce?  Usually the complaint is filed then a PSA is drawn up after both attys get to talking.  I'd ask why he's doing it this way.

    ETA: And yes, it's very difficult to see Lastname v. Lastname on the papers--gave me the chills everytime.

  • We had to do our PSA first as well.  My attorney said it was best to have this signed / notarized prior to filing.

    At least you are a few steps closer to being done with all of this though.  Soon you'll be in full control of your emotions and not have to worry about how each step of this process will make you feel.

  • The atty I'm using said there's no "magic formula" to divorce, but that we'll most likely get a faster court date if we file everything at the same time.

    Its very hard to see that! I seriously can't stop crying... dammit..I wish I didn't open it!!

    In my state, though, it's a 1-yr waiting period if you have kids OR no PSA. If you have no kids and have filed a PSA, then it's only 6 months. I wanted to make sure we only had the 6-month wait, so I did the PSA first.

    Was your divorce amicable?  Now I'm trying to figure out why my atty didn't do this?  Maybe because I surprised XH with filing (he had no idea I had left--left and filed the same day)...or maybe because I also filed an Order to Show Cause and froze his assets so my case was different.  Hmm...

    Yeah, MCC - ours is amicable ...so I'm sure that's why.

    Yes, it is.  I'm sure that's the difference.

  • Ok, glad that's the reason.  Since we're all in NJ I was starting to wonder if my atty effed up on procedure!
