Our tech team has launched updates to The Nest today. As a result of these updates, members of the Nest Community will need to change their password in order to continue participating in the community. Divorce and taxes?

My divorce was finalized in August. I'm wondring if I'll need to file as married or single for 2011.

Anyone have experience with this? Thanks!

  • Whatever status you are on Dec 31of the year you are filing, you file as that. So, seems you file single because you were officially divorced as of Dec 31, 2011.

  • you mean 2011? You can file single if your divorce was final in 2011
  • As pp have said, your status is whatever you were as of 12/31/11.  However, you have children, so you will file as head of household, NOT as single.

    THIS! CPA is a smart lady. :) Also - just to clarify...you do NOT have the option to file married anyway. You only go by your marital status on Dec 31. Luckily your divorce decree outlines who is entitled to the tax deduction for the kids? If it's you, I would file my taxes as.soon.as.humanly.possible this year. Beat XH to file. Cover your ass. You don't want to take your time filing to later find out that your XH claimed the tax deduction and you're claiming them for the second time. Trust me, the IRS isn't going to give a rat's ass about the divorce decree, and you may have to get a lawyer involved to get that type of issue resolved. :-/

    Thanks for the info. Ex-H is in prison ; for the next six years so I won't have to worry about this for a while. ;-P
