My Dad called me Friday afternoon and told me he could get the money I need for the attorney and we'll set up a payment plan for me to pay him back. I am so glad he was able to do this for me. Now, everything is up to me to get the ball rolling. Gosh, this is scary! My heart is racing as I am typing this.
I called the attorney to ask a few questions and am waiting for a call back. Has anyone with kids done a mediation? How did that work? Would we both see the same attorney and go through everything from who gets what from the house, how much CS I'd get, and a custody agreement? This can only be done if it's amicable, right?
Does anyone know if, once I move out of the house, do I still have to put money in towards the bills there? My name is not on the house, but the utilities are in my name. I don't think H will be able to keep the house on his own, so someone, him or me, would be at the house until it's sold so we'd obviously still have the mortgage and utility bills to pay. My understanding was that once papers are filed, and I am no longer living under that roof, that I am no longer obligated to pay anything for it, but a coworker said it might still be my responsibility. Anyone go through this?
Re: Got the money!
Woohoo! Glad you're getting the ball rolling.
From what I know, mediation is done through separate counsel--you each have an atty and then choose a mediator and that person "mediates" the terms of the divorce and presents it to each side until a decision is reached (hopefully).
I'd let your atty answer your questions about the house and utilities.
Also, remember, every call you make to your attorney and email you send, are billed to you. Literally, his time is money so write down your questions and get them answered quickly to keep costs down.
Good to remember about those phone calls. Getting the itemized bill from your atty with all your calls on there and the prices will help you keep that in mind though!
Re/ the bills - my attorney said that anything in his name is his problem and vice versa. They can't come after you for it.
This. Often the madiator is a retired Judge (at least where I live).
You need to ask your attorney if you would be responsible for the mortgage but my guess is you would be responsible for at least a portion of it.

Re/ the bills - my attorney said that anything in his name is his problem and vice versa. They can't come after you for it if your name's not on it bc technically you never consented to be accountable.
