A DUI

I found out over the weekend that my ex got a DUI recently.  Not only that but he is driving my daughters on a suspended license. 

Has anyone had experience with this?  Although our divorce is final after 2.5 years...and custody has been determined...I am assuming this will weigh heavily on custody issues?

  • Document everything you can by getting copies of the clerk's minutes.  Also, if you have proof that he drove on a suspended license with the girls gather that too.  I gathered everything I could from XH's criminal activity.  He was arrested on drug related charges in the next county over and had various court dates there.  I literally was on a first name basis with a woman in the clerk's office.  She gave me her direct number and every time there was a court date I called her to get the results and then she'd fax them to my office.

  • I would call the lawyer who handled your divorce and ask some questions.  Do you want to prevent your EX from picking up the kids when you know he is driving on a suspended license?  Do you want to provide all of the transportation?  Do you want to insist that your ex get another licensed adult to transport the kids?
  • Well... My XH has four (yes FOUR) DUI's on his record from 2003 to 2009. He hasn't had a license since 2008 and won't until 2016.

    Our custody arrangement says DS will only be driven by a licensed driver in a licensed vehicle. Can I prove that's happening? No, and I have concerns he's driving with DS during his visits. I don't allow DS to leave with him unless someone else is driving.

    As pp said, go to the courthouse and get copies of everything. I have an entire binder that consists of police reports, guilty pleas, charges, etc. from his file. Be prepared, here it's 50 cents per page to copy, so I ended up spending $100 and some dollars to obtain it all. This was for everything I could get my hands on, there was much more than these charges.

  • I can't weigh in on the DUI part but have it put in your PP that the children must be transported by a licensed, insured driver and in approved car seats to safeguard them.  This is word for word what it says in mine.

    If XH comes without a driver I have 2 choices,  say no see ya next time...or put DS in the car and immediately call the police.  I've had NO luck with the second option, the police put out a "watch" but will not keep me on the line if I'm following him driving to track him down.

    XH hasn't had a license since 2008, and thanks to some tracking down by my dad in 2009, was picked up driving (without DS in the car) and arrested.  CS has suspended his license and won't lift the suspension until I see some support.  Too bad XH doesn't care! :(
