What to ask the attorney?

I have a consultation with an attorney tomorrow (first one) and I was wondering if anyone had any questions they recommended I ask?

I have some basic ones, the main one being how to get him out of the house, if we should separate our bank accounts and how would visitation work during this process for the kids.

Also, is there anything I should bring with me?  It is a free 30 minute consultation, so I am not sure how much we will actually be able to go over.

    Retainer fee. 

    You can't get him out of the house unless he is a threat to you. Yes you should separate your bank accounts. You will avoid a lot of drama.

    This for sure. Get one tomorrow in your own name and start putting what you can in there including your direct deposits from work if you have that. You can write checks to your current H right now for bills if you need to. I lost thousands by not knowing to do that.

    Another question for this time of year would be taxes - how to file, etc. Also you mentioned a house - so property tax questions may be good to know as well - the basics for now and details when you have retained I guess.

    How long it will/should take in your particular case between filing and a final decree.

    If the attorney has a paralegal or partners that would also be working on the case or filing things for him. 

    That is all I can think of for now. But please talk to more than one, even if it costs for a consultation. I could have been in a lot better position had I not done a "one stop shop," and now have a new attorney, that came with a new retainer as well.

  • Also, don't be surprised if they tell you that they can't offer you any legal advice without retaining them.  They will be able to speak in generalities but will not be specific to your situation.

     

    Also, I agree with PP, you can't get him out of the house. I tried. But there was no abuse so I was stuck with him until I moved.  And separate your accounts asap.  

    PP mentioned about taxes too.  You will file according to your marital status on 12/31 so Married.  The divorce won't be final before you file your taxes this year so you should split the refund. That may have to be verbal with you H though.  Unless you have an agreement in place prior to the taxes being filed.

  • Thank you everyone!  I met with her yesterday and it was very informative and also very overwhelming. 

    I opened a checking account yesterday, am changing up my direct deposit and waiting to hear back if I am approved for a credit card.

    I started filling out the court forms today.

    I feel like I have been punched in the gut, but I know this is what is best for my family.
