Dutch ladies - tax questions.

I realize most of you are asleep right now but I have a tax question for you.

Is it possible for a married couple to file separately?  My husband's company is refusing to do my taxes but I talked to Blue Umbrella and they said that if you're a married ex-pat you file jointly.

What is your experience with this? Thanks.

  • Don't know about the American part, but I know Dutch tax law changed on 1/1/12 and the biggest changes are regarding whether or not you can or must file jointly. 

    It used to be a choice whether or not you filed together with someone, and the only rule behind it was that you needed to be registered at the same address. From what I understand (but I didn't look into it too much) with the new tax law:

    - legally married couples are required to file jointly 

    - legal partnerships can choose, provided you both are registered at the same address, but you're not allowed to join up/reap tax benefits with more than 1 person. (You can apparently have a legal partnership with more than 1 person, who knew??)

    - people who just live together can no longer file together. 

    Also, I do know that my friend who left NL halfway through the year, had to fill out a whole big giant form, that was only available in hard copy and only available in Dutch to file her final Dutch taxes. She had a company though, so that might have been because of that.

  • I just double checked it for you and that change was actually effective 1/1/2011 (it's become even more rigid in 2012 though).

    Since you are married, you ARE fiscal partners and it's mandated that you file jointly.

    The year you leave NL you are required to fill out the M-form (which is not available online).

    If you did not leave at the exact same date, you might be able to file separately (if there are enough days between you guys leaving, but I recall you left as a family, right?)

    Filing jointly in NL doesn't mean sharing one form though, it means you can divide savings and loans and other assets/deductions) over the two of you to maximize tax benefits. 

    If I were you, I'd find a good tax office in NL to fill it out for the 2 of you together, and call the Dutch tax office to ask for an extension asap, if you call them before April 1, you get an automatic extension 'til september 1, which might be useful if you need to file the M-form.

    PM or e-mail me if you have more questions. I dealt with my friends taxes when she moved back to the US, so I know a little about it, and I have some co-workers that work closely with the tax-office, so I might be able to ask more questions for you.
