Returning resident visa
Hey gals.
My brother in law wants to come with us when we move back to the States. He was a permanent resident when we moved here (his mom is a US citizen), but he has been out of the country for more than 2 years, which invalidates his green card.
If he applies for a returning resident visa, form DS-117, is he allowed to go to the States while that is processing?
Please let me know if you have any experience with this type of issue. He already has a job offer from his old job and has finances to back himself up. He stayed longer than expected to help take care of his parents.
