Buying A Home

We bought a house but...

We bought a house is the city both DH and I grew up in. We are both so excited about our big move! (20hours away)

We were all excited to move into the house at the end of this month/ beginning of next month but... The lady that sold us the house has passed away. (I am very sorry for her families loss). 

The title to the house can not be given to us until after the probate is complete! 

This does not have any effect on our rent where we currently live. (We found this out Jan 25th, so we did not give our notice to our landlord yet, thankfully).

The thing that we do not like about this now is that we will not know our possession date until 2 days before we gain possession!

Things will all work out in the end, I know they will, I just needed to get this off my chest.

Re: We bought a house but...

  • If you have not done so already, I strongly suggest hiring an attorney. In my state, it can take anywhere from 6-12 months for an estate to go through probate. Since it sounds like the house is part of the estate, then you may need to file a claim with the court to ensure that you can still purchase it, or at least get back the money that you have invested in the purchase up to this point.

  • Ditto pp.  Probate can take a very long time and I would definitely be looking for assurances or a refund in the event those cannot be made.

    We do have a lawyer helping us with this. 

    The lady that we bought from did not have a mortgage or any debt. (at least thats what we have been told). The family applied for the probate to be started already. Our lawyer said that because the lady had signed all the documents for the sale of the home while she was still in good health, (She passed away in her sleep, no health problems, they think it has to do with her H dying a few months ago) that the family is legal obligated to sale us this house. The only thing the sale was waiting on was the close date, (10 days after she passed) all other paper work was signed.

    I will be talking to my lawyer on Monday, asking her if there is any way that we could get out of the contract if it takes more then a month or two as we are both wanting to move to the city this house is in asap. After I have my answer from here we will proceed from there.
