update to hoa?

   So my rental manger was on her way to check out the issue, when she noticed something. They built there huge gate on my property. Not only are they almost 10 feet over the line, the builder took it on him self to cut down trees I had planted for an orchard. I have almost 2 acres so the renters had not noticed, and the gates were built after we moved.

   They are trying to argue some adverse possesion claim, since its been a few months, so I called a lawyer, set up a meeting, and I am so mad, but in a way thankful they started trying to charge me fees since I would of not known till it was to late.

  • I would be furious too! How irresponsible of them not to check the boundaries. I hope you get a nice settlement out of it!
  • Wow! I would think that they would have had to have a hearing with your town's zoning and/or planning boards before they starting doing any of this building. As an abutter, or in this case, the actually owner of the property, you should have been notified of a hearing. 

    We have someone trying to put a small housing development on land next to ours and the developer/builder has had to have upteen hearings over the last several years and they still have not received final approval. We have been notified in writing prior to every hearing in front of every board the developer has had to appear.

    Shocked you were never notified! Good luck, hope your lawyer can get this settled. Keep us posted.

  • Thankfully, it takes years (often a decade) to establish an adverse possession claim, so you being gone for a few months won't cut it.  But you do have to go to court to get this all formally settled and documented in the public land records, otherwise they can come back years later and say you knew & acquiesced.

    I seriously can't believe they did that.  Did Bubba just go by what he thought was the edge of the land?  I hope for your sake that you're the one who's right and that you don't own less land than you thought you did.  Oof, you could go back to the seller and get the purchase price adjusted...what a mess.
