Buying A Home

frusterated...

I posted on here a little while ago about buying a house, and now it has gone to probate.

The lawyer has reviewed my file and talked to the other families lawyer. He has then called me and given us 3 options:

1. walk away an look for a new house
2.tell them we will still buy if they get the paper work done and 2 us in X amount of days, if not we will walk, or
3.take possession of the house in a couple weeks and we get the title when the probate is finalized.(they can not charge us rent or any cost to live there, we would have to pay for all utilities though)

The lawyer has said that this is all up to us and no matter what we choose they will make sure that it is all legal and everything before we proceed. 

I like option 3 as it still gets us into the house. I have talked to our mortgage broker and he is going to follow up with me by the end of today or early tomorrow if this is okay on his end. (we just want to make sure the mortgage will go through if the probate takes 6 months.)

DH is at work and I can not get a hold of him so I  am trying to hold it together. We were just so happy about the house and everything and now I am so frusterated!

  • If there's no chance in option #3 that they could sell to a higher bidder or have a court ordered auction of the house, option 3 sounds great.  Free house for as long as the probate process takes.  Not bad.
  • As they are the ones who broke the contract, by not giving us the house on the closing date, it is up to us how we want to proceed.

    They have to sale the house to us if we still want it.

    They already have our down payment and all the papers were signed from both us and the seller before she passed, we  were just waiting for the closing date to get the house!

  • You love the house?  Then #1 is out of the option because every other house you look at will have to live up to this one.   

    Because I am sure you have been through a similar loss in your family at some point you probably know how overwhelmed the family is right now.  #2 seems out of the option. 

    She signed the papers.  Make sure your lawyer makes it legal and pick option #3.
