I was reading your post about your XBF owing you money and I got pretty mad on your behalf, for the record. My ex operates in much the same way, except maybe even MORE of a DB.
I have records of specific loans he owes me, for example, and he has promised over and over to pay me. I told him about a year ago to pay me back, even in increments, or f-ck off and stay out of my life. Despite that, he contacted me over the most recent holiday season several times, renewing the promise to make good on his debts. I'd like to add these are substantial amounts he cites, like $15,000. I told him I would like $5,000 for a few specific things - paying the IRS back taxes, and the satellite and phone that I kept on for six months after leaving - and again, that I would accept increments.
He sent back a completely volatile, two page response with gems like, "I was going to write you a check but I WILL NOT BE DISRESPECTED" and even an example of how I should have asked for the money: Apparently I should have thanked him for our time together and his constant sincerity and should also have said the amount was up to him.
And of course I'm over here, thinking, "WTF?"
But since this now falls under breach of written contract, I have records, and I'm tired of him trying to get back into my life, I'm going to take him to small claims. Either a judge will order him to pay or it'll be dismissed; no more time for games.
Sorry you didn't have the same records to recover your own losses...it sucks!
Re: similar post from startingover2010 about a week ago...
I'm glad you were smart enough to keep good records! I am pretty ashamed of myself that I wasn't. Best of luck to you in court...I'm by no means a lawyer, but it sounds like you've got the law on your side! Keep us updated!
